cracked sink. where do i stand.

Hi. I bought a ceramic sink online it arrived 6 weeks ago. it was signed for off the courier at the door when delivered and checked visualy as far as my wife could due to weight. So the box was opened from the top and in she looked. All good from what she could see. 2 weeks later the builder was supposed to fit our new oak kitchen worktops but canceled due to run overs on other jobs because of weather.A further 4 weeks on the builder comes to fit the work tops and does a great job he fits the new hob, when he goes to get the sink he takes it from the box in my wife's presents and when lifted out of the box he draws her attention to a missing piece of ceramic ( a large chip on the end of the sink the exposed side edge). she then reported it to the online vendor. They first said they would take it up with manafacturer then the courier but have now said they will not exchange due to the time we have had the sink. I have followed the saga while away working abroad. now home and would like to know exactly where we sand and doe we have a right to exchange.

After 6 weeks you are unlikely to get the vendor to replace it but a judge may side with you if you can prove the delay in fitting. It may be a slim chance though, if the damage is that obvious they could assume it would have been checked 6 weeks being ample time to do so, or dropped, It would be a chance though, so small claims would be your only hope.0
