Im not sure on your question but may I point out the obvious and say that do not pay by card. Pay over the counter as cash otherwise they will just raid your account.

i would pay it via faster payment using their bank a/c details then telephone them to advise payment has been made in accordance to the settlement offer and also request written confirmation that once the payment is applied the account is now settled.

hi my question is, now that I have this in writing, see above, when I make the payment will this stand up in court as a full and final settlement?

I.e I do not want to pay it and then they say I still owe them x amount this is only part payment.

Is the wording they have provided sufficient?

regarding payment, Its a bit too much to pay in cash what is the best other method please?

Sounds similar to the letter i had from them in regards to the same thing (full and final settlement). As above i used my online banking and paid them directly. I rang them afterwards and informed them of the payment and asked if i could have written confirmation once they recieved the amount which they said they would automatically send out a letter stating this. A few days later i hadnt recieved anything from them so rang them again and requested a settlement letter again, this i recieved a few days later claiming the that payment had been recieved and that the account was settled. The next month i checked my credit report and it was indeed marked as settled. Im sure you will be fine if you do it in that way.

Thanks. However, the person who is helping me with payment doesn't have online banking. Can we do it some other way which is safe?

Maybe give them a call and ask what they advise? im sure a card payment over the phone wouldnt be to harmless as long as they state in the call that the amount is for the settlement amount only £687 (all calls are recorded) and that this constitutes that the account is fully settled. They should then be able to produce and post your settlement confirmation letter as quick as possible. In my whole time of dealing with Mackenzie Hall i never had any problems and for the first few years they were only getting £1.34p a month on a debt of nearly £500..

If you supply them with your card details and there is enough money in your account to cover the whole debt, they can take it all regardless of what they tell you on the phone and you wouldn't have a leg to stand on. I have seen this happen to people on this forum countless times.

maybe best to avoid this method then? or make sure theres only £687 in the account? i would still advise musashi10 that direct payment via bank transfer would be the best and safest way.. if you cant arrange this method i suggest you call them and ask if they would accept a cheque maybe? and maybe extend the settlement offer by an extra 7 days to allow clearance?

You cannot even do this, because that doesn't stop the debt collector going back at a future date and trying for more money. For as long as they do not take more money that you owe them then it is perfectly legal.

If they take anything over the £687 then it is an unathorised transaction and a VISA chargeback will be immediately applicable.
Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.
