business banking - Should I be getting a refund??

Hey guys

I've searched online and cant seem to find an anwser to where I stand here. So I thought i'd ask on here.

I bank with the bank of scotland and have done for the past 15 years.

I have my current account, credit card (yes, i was also mis-sold ppi here too) and a business account.

When I started my business account about 5 years ago, the lady that sold it to me (the business manager at the branch) told me "when/if at anypoint you have £5000 in your account, then you wouldn't be charged any fee's" i.e. for paying in cheques etc

At the moment I pay anything from £5 to £20 a month in fees. These are all made up from paying in cheques.
And i've always had over £5000 in that account!! On the odd occastion its went down a bit but i'd take a guess that 80% of the time its been over £5k.

So my question is, what can I do about this? I'm sure if I call them they'll palm me off with some excuse why they cant refund me and maybe start offering me free business banking from now on. << Which would be nice but i'd rather have a refund too!

Would threatening to close all my accounts and move to another bank be a good option? I wouldn't mind doing this as I dont get great service in branch anyways.

    It doesn't matter what some lady told you. What matters is what the T&C and the 'Fees and Charges' list for your account say.
    E.g. I can imagine that they waive the fees for the months when the balance was £5000+ all days.
