    InsideInsurance is correct.

    Way back in the 1990s there was a case looked at by the old Insurance Ombudsman Bureau. At that time they used to load drink drivers for ten years.

    The Ombudsman decided that insurers COULD ask about convictions that had been "spent" for the purposes of the Rehabilitation of Offenders Act but could not lawfully use that information in determining a premium.

    With the advent of the Data Protection Act 1998, it is unlawful for any business to collect and retain personal data that it does not need so in effect insurers were forced to discontinue collecting details of spent motoring convictions (or penalty points).

    However. although under the "totting up" system points are only valid for three years, they only can only be regarded as "spent" after five.

    Since he was in someone else's car, was he using someone else's legs to press down on the accelerator pedal and go too fast?
