Uninsured expenses.

Last year, water from the washing machine in the upstairs flat caused my ceiling to cave in. My home insurance company paid up (eventually!). Now they say they are going to approach the tenant upstairs (I own) for "uninsured expenses" which apparently includes my excess.

Does anybody know how this works and what will happen?

    Given its tenant for a flat you own, who owns the washing machine? Why did it leak?

    These recoveries are rarely successful as they have to prove your tenant did something negligent
  • Suppose it depends on what the cause of the leak was and if the flat upstairs is let unfurnished. if it is your washing machine, your insurers may not succeed.

    No idea who owns the washing machine. I've never had any contact with the landlord upstairs and the tenant isn't exactly communicative.

    To be honest, I'm more worried about this damaging neighbourly relations!

    Your insurer is going to have to prove the upstairs occupier was negligent in some way in not dealing with the matter promptly when it came to his/her attention.

    As you've settled your claim, there's not a lot you can do about it. If anyone asks, your insurers have done this and you had nothing to do with it.

    It looks like your insurer has discovered that the leak was not an accident and someone has been negligent (eg maybe they used a plumber and he botched up).

    So they are pursuing the negligent party to reimburse them their outlay on your claim.

    If successful they will also get back the excess you paid and it will be refunded to you.
