Malicious PCN - Parking Eye

I've received a Parking Charge Notice which states "By either not purchasing the appropriate parking time or by remaining at the car park for longer than permitted, in accordance with the terms and conditions set out in the signage, the Parking Charge is now payable."

The only evidence supporting the charge are photos of my car entering and leaving the car park.

I am not disputing the fact that I used the car park, however I still have the ticket that was displayed on my dashboard and covers the period of my stay.

All of this happened of an evening when there wasn't any sign of a parking attendant and I think Parking Eye are just chancing their arm.

I want to make the process of concluding this malicious PCN as difficult, costly and time consuming as possible for Parking Eye and expose them for what they are. Therefore I have let them know that I have no intention of sending them the ticket but will produce it as evidence if they decide to take me to court.

Grateful for any advice on my proposal.

Well appeal to them along the lines of

    Dear Parking Eye

I am appealing invoice # 123345 dated 21/03/13, I have a valid p&d ticket for the period I was in the car park. So I contest that your parking charge is valid and I admit no liability to yourselves.

If you do not accept my appeal I require a popla verification code within 35 days of this appeal to be sent to me, as per the BPA Code of Practice if one is not given within that timeframe the appeal is automatically allowed.

I look forward to your reply

Was the ticket machine one of those where you have to enter your car registration? If so the photos of your car entering and leaving the car park are supposed to tie up with your ticket. If you mistyped the registration or their systems fouled up then this could be the reason why they even think that they can pursue you for one of their fake PCNs like this http://www.bbc.co.uk/blogs/x-ray/2010/11/parking-charge-confusion.shtml
