Just wondering what my rights are on a well known designer watch bought for me Christmas 2011 from a duty free store at Gatwick (duty free value £360)
It came with a two year authenticated guarantee from the designer. the watch always ran slow then the crown fell off completely September. The designer store sent it off for repair which took six weeks so I got the watch back November. I wore it twice and the crown fell off again and it has stopped working completely.
The designer store wants to send it off for a repair again which I am not happy about as i have lost confidence in both manufacturer and designer and has also said it is the manufacturers responsibility not theirs and that I could potentially get a credit note from the manufacturer...... Whoever that may be. Surely I should be entitled to at least a credit note from the designer store not the manufacturer???
To top it all Gatwick is under refurbishment and returning to the purchasing store in not an option.
Everyone is passing the buck. What are my rights here????

Take up their offer because YOU have none. You weren't the purchaser and have no contract. The purchase could take it back to the store and pursue it (but that sounds tricky).0

My Husband was the purchaser and we have the original receipt. He has been the one dealing with the designer store but it seems they are fobbing him off.0

You don't need to keep saying designer store. It's a £360 watch, not a Rolex!0 -

There are two issues at play here, the Sale of Goods Act (your statutory rights) and the Manufacturers guarantee.
Under the SoGA it is the stores responsibility to sort out a remedy - a refund, replacement or repair. At this stage your best bet is to let them have it for repair again, and see what transpires. If a further fault happens (or the current fault isn't repaired correctly) you'll be in a much better position to press for a refund then.
Under the guarantee it depends on what's written in the terms and conditions.
If you want to claim under the SoGA don't let the store try to palm you off to the manufactuer - remind them it's their responsibility as retailer.
You might want to start writing letters, as this gives you a paper trail if you need to threaten court action later on.0
