Csa Is Killing me off slowly

I HAVE A CASE WITH THE CSA

ON DEC 2010 THE LINCOLN COURT CSA AND MYSELF AGREED AFTER BEING MEANS TESTED BY THE LINCOLN COURT THAT I SHOULD PAY £35 PER WEEK NO MORE NO LESS

WITHIN ONE WEEK WHILE I WAS PAYING THE SUM OF £35 BY D/D THE CSA WITHOUT WARNING TOOK £90 FROM MY WAGES WHILE I WAS STILL PAYING THE £35 TO COURT THE WEEK AFTER THEY TOOK £120 WHILE I WAS STILL PAYING £35 TO COURT BY D/D AND FOR THE LAST 3 YEARS HAVE TAKEN £153.45P PER WEEK YES PER WEEK AND NOT PER MONTH FROM MY WAGES WHEN IT SHOULD HAVE BEEN £35 PER WEEK

I HAVE BEEN LEFT WITH £50 PER WEEK TO LIVE ON FOR THE LAST 3 YEARS NOT EATING SLEEPING AND STRESS HAVE MADE ME HAVE A HEART ATTACK AT 47

NOW AM ON SSP OF £85 PER WEEK AND CSA STILL TAKES £35 WHICH AFTER THIS I MUST PAYFOR TABLETS FOR MY HEART OF £10 PER WEEK WHICH LEAVES LESS THAN THE RATE TO LIVE ON £40 FROM THIS I MUST PAY RENT GAS WATER ELE AND COUNCIL TAX OUT OF £40 POUNDS AS WELL AS FOOD WHILE RECOVERING FROM HEART ATTACK AND STRESS MY GP CONFIRMS HEART ATTACK WAS FROM STRESS FROM CSA but now they take it from ssp witch is more stress and my GP as stated anymore stress and I COULD have one more Heart Attack which I my not recover from
but yet I have not found a solicitor that deals with CSA cases the ones that do don't even read what I put and tell me its £150 for half hour what happened to free half hour but yet am entitled to legal aid

Article3 No torture, inhuman or degrading treatment

    This could save you quite a bit, instead of £10 a week, it would be £29.10 for 3 months.

  • thank you cte1111 will looking in to working tax credit too and try and see if I can get this but last time they said no they look at the top line and not look at the £153 that goes out from wages

    You are not going to be able to pay for advice to deal with your problems with csa; so if you feel that csa have not acted correctly your best course of action would be to ask your MP to help you to sort out your csa problems.

    Apply for an injunction against any deduction for breach of of court order...!!!

    Can be done yourself and is easily filed in the county court...
  • thanks justontime but so far I have got to the (ice) independent case examiner stage the csa told him that they can take it !!!
    so while off work I get ssp £85 -£35 csa=£50
    in work £300 -£153 csa-£72 rent -£23 council tax travel to work £30=£22 TO LIVE ON
    dole £72 and rent paid and council tax and £5 to csa
    but to give up work I don't get anything for 6 months well all my savings have gone so no hope there

    You need proper advice here. The court agreement will only have related to a certain portion of your arrears which will be specified in the documents, CSA will have applied for a liability order for this money as you had already failed to pay it. The deduction from your earnings will have been the ongoing maintenance and possibly other arrears not covered in the liability order. They can deduct up to 40% of your wages and if you have failed to tell them of your change in circumstances (going on the sick) they will not have recalculated and you will be stacking up more arrears right now.
  • thank you for your reply missbunbury well the case with csa started 2007 (why) well after 15 years the ex refused to see my son and I found out my name is not on birth c right or wrong I stopped paying so was nill payment till 2007 but my son started work 2009 full time even have a letter from judge showing this so payments should be 2007-2009 at £35 per week =£3,360 from wage of £220 which was all but paid off
    but in 2009 I changed jobs and never informed csa 2010 I was in court they said I must pay £35 per week D/D WHICH I DID I agreed csa agreed and court agreed first week £35 d/d no probbs 2nd week £35d/d from bank BUT csa took £153 from wages of £300 from 2010-2013 they took £153 per week =£22,032 est so wage =£300-£153 to csa =£147 - rent council tax =£53 travel to work £30 per week left me with £23 for food and bills after 3 years = heart attack so sick pay now after csa take there cut am left with £50 but dole is £72? but yet my son has never lived with the mother she had 6 kids with 6 dif fathers she has even media profile saying no kids live with her even eletroll roll shows she lives with new parner but yet she get family tax credit housing benefit child benefit and my £153 quid

    Amend you DD to a standing order immediately , they can only take what is on the order and not amend the value.

    So was the case first opened in 2007?

    As we learnt, you really do need to keep the CSA up todate with any change of circumstances.....otherwise failure to do this can result in it coming back to bite you on the bum!!!
