Need some quick advice please

Hi,

I bought a large piece of nursery furniture from a store that is over 150 miles away from me. The lady that sold it me told me it was a certain colour, and when I came home and opened it, it was a completely different colour.

I rang up the store and they said they could give me a refund if I bought it back in. I can't however drive up 300 miles to return it, and it wouldn't be worth the cost either. I asked if they could send a courier which they refused, and I then offered to send it via a courier from my own cost, which they are still thinking about.

What are my rights in this situation? Do I have a right to a refund as it was mis-described to me? There is no point me keeping it as its the complete wrong colour! :(

    Yes you have a right to a refund as it has been mis-described (but having said that colour can be subjective - is is defo completely the wrong colour or just a bit different?).

    You also have a right to either have your travel costs refunded or the cost of the courier. If you have to send the item back via your own courier do so - then claim the cost from them.

    Was it the sort of store where the items are on display and you take a slip to the till to buy the item and then the goods are brought to you boxed? If so what did the slip say, what was written on the box? If you selected the wrong ticket or took a box that is clearly marked with the colour of the item that is in the box then I don't think it is as clear cut as others have said. If however the receipt shows that you paid for the correct item but they gave you the wrong item then the shop should rectify their mistake.

    What do you mean by different colour?
    If you ordered red and it was green, no bother.
    If you ordered gold and it was yellow, it is not as clear cut.
