Hi, not sure if this is the correct thread so excuse me.
Basically I currently have a credit rating of 779 (credit expert), any I cannot currently get any extensions on my existing £900 (student) overdraft or change to a different bank, due to late mobile phone payment situation....
Basically in may of 2012 I rang up my mobile phone provider (orange) and told them I wanted to buy out of my contract early (ended in July). The lady of the phone told my this was fine and that I would be billed the leaving fee however the contract was not cancelled when requested and continued through till the end of the contract (even some bills came through after the contract finish date
, like ones in September saying minus amounts etc, really not sure why).
The bills for this and any debt notifications had been send to my old address (not my university address) so I hadn't seen any of the letters until it was too late. I spoke to both Orange and the Debt Collection Agency over the phone and explained this situation about a million times but each time they would tell me I needed to speak with the other party, so I got nowhere.
My question would be, considering this information, would I have a valid case for this to be removed from my credit report?
As in my eyes orange had made a mistake by not ending the contract when requested, or would I be at fault for not changing address'?

Do you have any paperwork stating in writing that the contract was to be terminated early and the date this was to happen? Did you receive a bill with the early leaving fee set out? Most importantly, did you PAY the early leaving fee?
If yes, then you have a good case to firstly make an official complaint to Orange and then (if you get nowhere) to request the CRAs remove the marks.
If no, then I'm afraid it looks like the Orange employee never actually cancelled your contract and unless you have some way to prove you asked to cancel it, there may not be much you can do.
The overall lesson here is make sure you read your mail, wherever it's going. In your situation I understand why you didn't change your address - I'm a student too and in the same boat here. Get e-bills wherever possible and make sure you keep a close eye on this sort of thing. Don't trust companies to do what you expect - they exist to make money and are not your friends!0 -
In future follow up the phone call with a letter sent recorded delivery.0

I didn't receive a paper bill stating the charges till awhile after the contracted had terminated, not sure I'de still have the paperwork and I can't see any other way of proving the situation.
