DLA renewal claim

    I have finally received my award this morning, albeit a week or so late!

    However, I am terribly disappointed that my rates have been drastically reduced despite the fact that my illness hasn't improved and if anything is probably slightly worse :(

    Is there any way of appealing the decision or is that it now that it's been awarded? I know you can appeal if they turn down an award but have no idea whether you can appeal the rate they actually award you :o

    Yes, you can appeal the rate awarded to you.

    I was in the same situation as you, my illness had gotten slightly worse yet they reduced my rates when it came to be renewed.

    I called them and they advised me to write a letter saying why I disagreed with their decision and giving any further information.

    They didn't go back to my doctor for further info, nor call me in to see their doctors. Just sent me a letter back (took about 5 weeks) saying they had reassessed my claim and were putting me back onto the middle and higher that I had been on previously.

    i have been on dla for 15 years and they just decided to give me nothing ... i am in the middle of an appeal

  • My dla care was cut from higher rate to lower when I did my renewal.
    The reason being a very confusing " not being able to cook a meal for myself" not sure why that makes me unable to have higher rate? if it was" able to make a meal " I would understand that
    Anyway appealed and asked for a written appeal as I could face sitting in front of a group of strangers
    They said I hadnt sent enough info so they sent Dr to examine me at home
    I have been sent his report which basically says there is nothing wrong with me !!!!!:mad:
    I had mri done ( privately as my gp refused )on my spine ,knees and shoulder which were all causing me pain (and getting worse)
    I have advanced arthritis in both knees ,no cartlige ,and lots of other things wrong with the knees as well
    My spine has a 4 slipped discs,also a couple of other complaints such as spondolysis and spondolysthesis ,which means there is a fracure is in the disc and slippage making the spine unstable with too much movement.
    I gave the report to me GP today and even she said there is nothing wrong with me !!!!!
    What can I do ? I am in constant pain,and can be laid up for months on end as I sometimes cannot even stand as the pain in my knees is that bad ,I am now scared that my benefit will be cut off totally and I will be in such a mess if that happens ... as they will be going on the report from the Dr who visited me and he reckons I am able to do everything ... how he came to that conclusion after seeing me walk 3 ft I dont know ,he even said I had mild pain ... how would he know that ? and said I could walk over a 100 mys before any discomfort
    Help !!!!!!!!!!

    Thanks, that sounds encouraging.

    I spoke to a lovely lady at DLA and she read back to me the DM report that my award was based on and is also going to post me a copy.

    It seems they have dismissed a lot of the information and evidence that was presented to them so she advised I keep a diary over the next 7-10 days and submit that along with any other evidence I have, such as letters from my carers etc and they will reconsider the decision.

    If nobody was taking me serious but I had medical proof, then I would pay out and see a private doctor and get them to back the DLA claim.

    Hi again, sorry to bother you all again but I really need some more advice :o

    It's been more than 2 weeks since I called the DLA people to ask for a reconsideration on my award, and I received a letter acknowledging the fact within a few days. However, I still haven't received a copy of the DM's report stating what basis they made their decision on. Is it normal for them to take so long in sending it? I'm just getting a little worried that I might run out of time to qualify for the reconsideration.

    Also, I'd like a little help/advice with this diary that they've asked me to keep please. I'm not entirely sure exactly what I need to write, and what I've written so far seems to be more of a "personal" type diary of how my days/nights are spent.

    Is this the sort of thing I'm supposed to do or do they just want to know what I needed help with and for how long? If this is the case then what do I say about the days when I haven't managed to do some things, such as cook a meal, have a bath etc as I haven't actually received any help with that as I just haven't bothered eating/bathing or whatever on that day.

    Sorry, but I'm just getting so confused and muddled up with all this :o

    Oh, and if this wasn't enough to be dealing with I've just received an IB50 form too to complete and send back, which I was previously exempt from having the higher care rate, so now I'm panicking that they're going to cut all my benefits completely :(

    I really think you need better advice than we know the answers to on this forum. Can I suggest you take a look at www.youreable.com. Their forums are extremely helpful and have sections dedicated to benefits and appeals.

    Hi Chamelion, I would endorse the previous post and would also recommend you follow this link, become a member for £16.50 to receive the very best guides available.

    Personally I would not go for a reconsideration and go straight to appeal as this process will include a reassessment of your claim. All the advice you need is at the link I have listed above.
