European Small Claims Procedure

I would like to take Ryanair to court to claim compensation for a 6 hour delay on a recent flight which they will not pay as they argue a technical fault with their plane is 'exceptional circumstances'. I am planning to complete form A of the European Small Claims Procedure: http://ec.europa.eu/justice_home/jud...ling_uk_en.htm

Am I right in thinking that the fee is £25 to file this with an English court?

If I win, is the fee refunded?

If I lose, or if Ryanair appeal, could I be liable for their costs?

Apologies if this has been covered on here, I did have a general look around but couldn't see the answers.

    This is out-of-date legally, but gives some initial information on how to take legal action against them.

    Doesn't the European Small Claims Procedure just get routed through the UK courts anyway?

    Thanks for the link. It complains about not knowing Ryanair's address, but I have this on a letter from them as Customer Services Department, PO Box 11451, Swords, Co. Dublin, Ireland.

    I believe I need to route the European Small Claims Procedure through my local court in the UK, yes.

    I just wondered about the cost and check that I do not become liable for the costs of Ryanair's defence!

    Sorry, I don't know the answer to your question, but I would also check that a PO Box address is ok.
    Bit difficult if you need to send the bailiffs round. :D
