Specky four eyes

Hi

I am have a nightmare with this awful company and I'm after a little advise. I ordered some varifocal glasses from them 2 weeks ago and they send me out the frames for pupal distance measuring. I was not happy with the frames as in their description they were detailed as purple and when they came the glasses were pink. I wrote to speck four eyes and asked for a refund as I was not happy to spend £130 on glasses that that are a different colour.
I was shocked at their response and have never had such bad treatment. I was first of all told that they could not give me a refund because in their words was only a little bit pink. I wrote back to them and said I was not happy with their reply. I was then given a lesson on how pink was a male colour and was a off shoot of red. And that blue was a female colour. I couldn't believe would I was reading. (I am male)
I am absolutely disgusted with their lack of customer care and contacted trading standards. They advised me that I could probably not go down the distance selling act because although the lens have not yet been made for me I have bought a item that would. They advised me to go down the route of 'Not as described' , Can anyone one on here give me advise on how I get my money back from this truly awful company. This is my first experience of buying glasses on line and on recommendation on this site. I will never do it again, They have offered me a credit note but I have no confidence with them,
Any help appreciated.

    Anyone offer any advise on this to help me?. I have taken the advise of trading standards and written a letter. I have got a case number and they are willing to follow it up. I have asked speckfoureyes to forward me the details of the glasses at point of purchase but don't suppose I will get it. The glaases are no longer on their website.

    If you paid on credit card you have section 75 protection there (there's an article on MSE). But their terms often stipulate you try to resolve it with them first.

    If they are significantly different you are entitled to reject them.

    Send a letter stating the goods do no confirm to contract and you require a full refund within 7 days before you take further action

    Thank you for taking the time to reply. I have lost all confidence with this company after the replies they have sent me. It is either by someone young or someone having a laugh. I have written to them and asked them to respond to me withing 7 days. I don't hold much hope of them doing this.

    Wait for their response. If they won't refund, then take it to your card company

    You have contacted trading standards and received advice from them which you say you are following. What more do you want from posters here?

    Was the advice from TS not what you wanted to hear so you're hoping others will tell you something more in line with your expectations?

    I wanted to know what my options are as I have no confidence with customer service at speckyfoureyes. Also the advice on here about taking it up with my credit card was very useful and something I didn't know I could do.

    Could these not fall under Sec 75 because these were specifically made to order?

    I also think you should have taken advantage of the try before you buy so you could see the frames before proceeding with the order

    Section 75 makes the CC company equally and severally liable for breach of contract - this isn't a DSR issue, but a Sales of Goods Act issue which places implied terms within consumer contracts. In this case the goods do not conform to contract and op is entitled to reject them in accordance with the SOGA.

    As an aside though.... DSRs exclude personalised goods, not goods that are made to order.

    Correction: not exclude personalised goods from DSRs, merely exclude personalised goods from your rights to cancel under DSRs.

    Next time try spex4less. I've bought several pairs from them and the quality is excellent. Once I accidentally ordered the wrong lenses and they just sent me a new pair free of charge.
