Well if he has agreed to pay 50 a month recently then he can no longer have it statute barred because he has just acknowledged the debt.

    Not correct.

If the debt is SB, then it will always be SB.

    Acknowledging/paying cannot un-SB it.

    EDIT: Beaten to it. :)

Would the debts still be statute barred even if a CCJ was passed?

This suggests that it is more than 6 years since this debt was defaulted.

Also you do realise that even if there is a CCJ for the other debt, after 6 years they need court permission to collect?

thanks RAS, just saw this - are they likely to be given court permission to collect it after 6 years?

Also, how would we find out of a CCJ was passed without contacting them again? Capquest said that there was a CCJ passed but Citibank didn't mention anything about a CCJ

Are the CCJs listed on the credit report? If not then you could assume they were over 6 years too and they would need to go back to court for permission to collect.

Anything on his credit records? I would expect a CCj within the last 6 years to show up there.

The Registry Trust lists CCJs but he needs to know what address he lived at when last in contact with them as that is the address they will have used to serve notice. Think it is £8 per address.

They would need a very good reason to get it enforced by a court.

What type of reason would constitute a good reason?

There are no CCJ's shown on the Experian file.

Do we need to order an Equifax file before we send any letters off? Do Equifax normally show the same information as Experian??
