Canceling an international order (faulty goods) from ROI

Hi,

I ordered and have received a custom built guitar from a maker in Ireland, it is however faulty so I'm pursuing a refund or replacement.

If the manufacturer is uncooperative I can pursue the refund through my credit card company (50% deposit) using section 75 and paypal (balance of 50%). I've plenty of time to do this.

However belt and braces is it worth officially asking for return/refund using distance selling regs? I think I can do this up to 7 days after receiving the goods (today).

If it is worth doing does anyone know of an off the peg letter or form of words I can use?

    No.

    The ROI is not covered by UK distance regs and you will come across as aggressive before you have even started discussions. Phone him and have a chat first and stay calm.

    There does seem to be EU distance selling regs, sorry can't post a link as I haven't enough posts under my belt. It came up by googling 'eu distance selling regulations'

    How "custom built" is it as that may exempt it from DSRs anyway ?

    Built to order, a standard model with a couple of upgrades.

    Do you have proof, that what you ordered is diffrent to what you recieved.
    If not then any claim is destined to failure.

    S 75 covers breach of contract and misrepresentation. Which you have to prove.

    That may not be considered faulty but just a characteristic. Does it have a truss rod?

    Yes and admission of the problem by email, there was also an unannounced and unapproved change to components also documented.

    Yes it does have a truss rod but even dialing in some back bow to the neck won't solve the problem. Truss rods aren't for adjusting action, they're for adjusting how much relief the neck has.
