  • well, they have now, reply with the info, if he isn't working he won't have to pay. It's not your responsibility, I did this for years the xmas/birthdays stuff and bought things as the lazy dirty ex dressed them in second hand clothes............grrrr rant. Anyway, if he isn't earning he won't pay

    If you don't you will accrue arrears on their imputed decision........no choice really but to reply

    It sounds like a standard letter. Write them a letter in reply and tell them youve not received any contact before this letter and ask them to send you another letter with the information they previously requested plus a copy of your file.

    I still dont understand why you have been paying for your husbands child if he's unemployed. Did you inform the csa when your husband became unemployed? as if he's not claiming any benefits then you would probably have received a nil assessment and you wouldnt be paying any child maintenance.

    If you have been married for ten years, as stated in post 3, it is likely that your husband is on CSA1. In that case, I believe that your income is taken into account as well as his income. Having said that, so are housing costs and other costs.

    As your husband has been working on and off, he should have informed the CSA each time there has been a change in circumstances. If he hasn't, there is a possibility that arrears have accrued. The occasional payment of £40 may not make much difference, but it should count.

    I suggest that your husband requests a copy of his file, and my understanding is that there is a small fee for this (£10?). Once you have this, you will know where you stand.

    Just another thing, if there are any arrears due to the PWC, they do not go away even once the child is an adult. If there are arrears and your husband has not informed the CSA of any change in circumstances, such as no longer working, I don't think there is much room for appeal. Even if the CSA has not contacted your husband, he still had a responsibility to contact them.

    are you serious? how utterly insulting to all those parents out there who are struggling to get by and have no choice but to accept and use hand-me-downs, buy from ebay, car boots and charity shops etc. My children rarely have new clothes but I can assure you that I am neither lazy nor dirty and nor are my children.
  • you misunderstood me, I have and use second hand things myself and so has my son, toys and clothes. What the ex used to do was leave other kids names in the clothes and dress in designer herself, she got a fortune of child support and the kids had nothing. I bought their clothes and helped to pay the maintenance, especially when they arrived for a week without even any underwear !!!! and in clothes two sizes too small and with no uniform or PE wear

  • you would need to check if the standing order is set up to the csa or to the child(rens) mum.
    If they are talking about a default maintenance decision the case must be on cs2
    obviously its hard to say without know the full details of the case but it looks to me as though they have been asked to bring the case up to date (a change of circs) this may have been asked for a long time ago and has only been worked on now - if your partner isnt working his assessment should reflect this - i.e he shouldn't be assessed to pay anything.

    Provide the CSA with the information that they are looking for and have the case reassessed. From what you've said this is likely to reduce the liability (unless there are previous arrears).

    You then have two options:
    • Pay the rate the CSA say needs to be paid. I'm guessing this could be £5 per week; or
    • Pay the rate the CSA say needs to be paid but pay extra on top (to maintain consistency of what you have been paying) if you want to.

    Also you might want to consider obtaining authorisation to deal with the CSA directly. Your OH will need to send them a letter of consent.

    Especially if you're the one who is taking responsibility for making the child maintenance payments.
