Shop direct reclaim charges

Hi I have tried to claim my charges back from 3 different accounts with Shop Direct. I was and am having DM with CCCS and during the time CCCS have been paying them they have charged me different charges while they were being paid. Phone calls that are for a number that I have not had for 3 years, late payments ect. I sent the first letter asking for all charges to be refunded I have received a letter back saying they will not be paying them back as they are fair and it is their full and final response.
I'm not sure where i can go from here, do I get in touch with the FO? or send a second letter. Or am I fighting a loosing battle. I would be grateful for any help please.

    Are the charges over £12 each? If not the FOS won't help you.
    (The FOS will help if they are > £12 as charges in excess of £12 are considered automatically unfair by the OFT unless the service provider proves otherwise)

    So if they are £12 each or less, I suggest your only option if you wish to pursue this claim of unfair charges is to go to court and get a judge to decide.

    This only relates to late payment and/or over limit charges. There is no guidance given by the OFT for other charges, so you will have to ask a court for a decision as to fairness no matter what the value of other charges are (e.g. telephone calls)

    Hi Wywth thanks for your reply, no they are for £12, but are they not unfair if they are trying to call you charges or for a letter? Also CCCS would pay them the same time every month and they still charge the late payment fees. Can they do this? the letters and charges are from NDR and I didn't think a third party could charge me these extra fees, i'm probably wrong. regards

    If CCCS are paying the credit card company the same date every week and you are still getting hit with late payment charges, then it sounds like CCCS are paying late every month, so your beef should be CCCS.

    Also, if CCCS are paying under a DMP, then they really should have been onto your creditors to request all future charges are stopped whilst they repay the debt. The creditor doesn't have to agree, but most do. Something else to take up with CCCS.
