some advice needed please. My mother passed away and after paying for the funeral and waiting for other bills to come through to settle i have received a check for 3600 from her estate. As i am in an iva i realise any monies i receive must be paid into the pot, the dilemma i have is this money still needs to pay for completion of her bills owing plus the headstone and surround to be put back in place in 6 months. she wanted my daughter who is disabled to have any remaining money that was left from her estate. As my daughter and myself have the same initial could i pay this into her account or would that be wrong, i really need some advice especially as the amount will be less that the check anyway once things have been finalised and i want to do what my mother would have wanted. This money is not mine anyway but i am classed as her next of kin so this is my problem.

Firstly I am very sorry to hear about your mother-its devastating when you lose a parent.
As far as the money you received is concerned it matters little where you put the money- it's the amount of "windfall" payment you have received.
If you have obligations with that money I don't think it's unreasonable to declare just the net amount you end up with after your expenses.
Keep an account of the money- what you have had and the amount you spend and then let your IP know once you are sure no more money has to be spent and you know what you have left.now debt free and determined to maintain good spending habits and build savings0 -

Sorry to hear of your loss.
Agree with the above post, but all it takes is for an unreasonable IVA case worker to start quibbling over what they deem to be reasonable in the circumstances, and you might find yourself facing a payment demand for the difference. (I would like to think that this would not happen, but we hear enough anecdotal accounts to make me think it could be a possibility).
Personally if I had a sibling with the same initial, I would as you elude to, pay the cheque into their account, and keep quiet!!! (thus avoiding any complications).
As you say, you may well have other bills associated with disposal of the estate etc anyway.
Now that's all well and good if the money has been paid by the executors of the estate to cover out-of-pocket expenses etc.
If however, this money was left to you as a bequest, then you may well have to pay it over. You have to consider the possibility of your IP failing your IVA if they found out that you had 'hidden' anything.

Thanks to you both for your replies. I had to sort out my mothers affairs as i was the only one to do it, all she had bless her was enough to pay the bulk of her funeral costs and then the remainder her bank sent to me as a check. No probate or anything all pretty straight forward. I am waiting for further final bills which i need to pay and i need to keep some money to replace headstone and surround and the cost of the stonemason. The problem is i have to wait 6 to 8 months to replace the stone. I feel it unfair my mothers money gets lost paying something i did as my daughter then misses out on something that should have been hers. I will have to think on this one.0

If you are administering your mothers estate then it's not really your money until there is something left, when I suppose if there is something it will be yours. Uptomyneckinit- good point, it might only take someone who was not prepared to understand the situation to be unreasonable I'd not thought of that.
