Help please - Tenancy Laws

2 weeks a go we moved in to a rented property which 6 months contract. The agent said this could be extended to a 12 month contract after this period.

The flat was available for long term rent.

We have just found out that the property is also on the market for sale. Both owner and agent new this before we signed our agreement. The property is not advertised as investment only.

If we knew this we would have never have moved in as we wanted a rented property for long term.

We rang the agent and they told us we were not meant to find out it was for sale! Also said it was no concern of ours!

I'm sure this should not have been allowed? I could be wrong though.

Ideally we want to move and find a new place which is actually long term.

I am not happy having stumped up a big deposit, paid for the cost of moving and reference fees all for this to happen.

Any advice greatly appreciated.

    It is allowed.

    You are legally entitled and must stay in the property until your contract runs out. If you want a longer contract then negiogiate now for one for 12 months and get it signed and agreed.

    The new buyer would then most likely be a landlord as noone else would want or be advised to take on a property with tenants who are there for a long time.
    I'm not cynical I'm realistic :p

    Morally yes but legally no.

    The LL may have something pushing him/her into selling it suddenly i.e. a sudden death in the family, lots of debt, interest rate rises - who knows.

    I would personally try and find out why the landlord is selling.

    You can refuse to let the landlord or agent in to view the property with potential buyers but if the landlord is in debt and the place gets reprocessed you will be forced out within 28 days.

    If you want to stay there for 12 months, get the tenancy agreement sorted asap.

    Make sure the Landlord is protecting your deposit too. You don't want them going broke & taking it with them.

    you could consider buying it yourself. Put in a low offer though as it comes with sitting tenants that might be difficult to get out!

    Actually I have been told that buying a house with tenants is a big no no as their AST contract was with the original owner, therefore they would be very hard to get out.

    What a totally crap agent.

    My last rental I found the property was for sale but I got a far different response, the agent said it'd been up for both sale and rent to see what happened first. The agent apologised and removed it from sale immediately. But then mine was a good agent. I was eventually asked to leave though so it could be put up for sale. Still hasn't sold and is now up for rent again!

    As for it being your concern, of course it is! You want to know if it's likely you'll be asked to move. You want to know who will be visiting your home. You have the right to refuse viewings, it's not on to have them so early in the tenancy IMO. Given the agent's attitude I bet they'll try to sneak viewers in while you are at work. So make it clear you won't tolerate this, make sure you'd know if someone has been inside and be prepared to change the locks if the agent doesn't play nicely.
