Dead toaster after 14 months - would you claim?

Having tired of cheap toasters that only last a year, I decided to splash out on a £40 Russell Hobbs toaster. It lasted 14 months before breaking - just outside the warranty, of course.

I emailed the supplier, who basically said it was not their problem. Since then, I have quoted the Sale Of Goods Act at them by email and post, but they have chosen not to respond.

If I continue, the next step, as far as I can tell, is a county court claim - unless anybody knows any different?

I feel like I should I continue on principle, but it's probably not worth it considering the value of the item. What would you do?

    By supplier do you mean the retailer/ merchant? It is them, if you mean you are speaking to the retailers merchant then you aren't speaking to the right people.

    Letter before action would be the next step and possibly worth sending even if you dont intend to follow through with the action, just make sure you get a proof of sending for it.

    On the basis that a settlement would be net of any use you've had out of it then to me less than £40 wouldnt be worth my time and effort to do but then there is the principle that can override the sensible option

    Don't you have to get an independent report done on the toaster to confirm the fault was inherent? For a £40 product I would say its not worth the hassle.

    I tend to agree. I'd certainly have better things to occupy my time.

    Been there before with toasters after a bit of research (inc Which) ended up going for a Krupps, I think it is now over 6 years old.

    I think with toasters the key is to keep it as simple as possible, if you want an all singing dancing one you are just asking for trouble.

    The toaster before was a Dualit (not the expensive ones) as I thought it would last think we got about 2 years out of it :mad:

    Thank you for your reply. I've been in contact with the online shop that I purchased it from (because the contract is between me and seller). I've sent a letter and have proof of posting.

    I'd expect it to last maybe 3+ years so your effectively seeking a refund of about £20 - £25. Only you can decide if its worth getting an independent report and going to court
  • What part, specifically, did you quote?

    I used a standard letter from Which? magazine:
    "[FONT=&quot]The Sale of Goods Act 1979 makes it an implied term of the contract that goods be as described, of satisfactory quality and fit for purpose. As you are in breach of contract I am entitled to have the item repaired or replaced and I would request that you confirm that you will do this within the next seven days."[/FONT]

    My Russell Hobbs toaster has a 2 year manufactures warranty. Maybe it's worth checking to see if yours does to.
