But if you maintain, repair, or care for them, you do NOT get oil stains, CO poisoning or smelly carpets!
Sorry. You caused the problem so you are responsible. As a tenant you should return the property (including the drive) in the same condition as when you moved in, less fair wear and tear.

and the oil leak was repaired! it has not been added to since i pointed it out to him 6 months or so ago and he wasnt bothered! i suspect he only is now becuase its his daughter having the house

I agree that the T has a moral obligation to remove the oil stain caused by leaks from his car. But if the inventory makes no mention of the driveway's condition isn't the LL in a weak position to claim the cleaning cost from the deposit?0

this will annoy the LL more than the oil stain, as he will have to give you the money back, chances are he hasn't got the money
If the money is in a protected scheme then this is not an issue.0
