First APCOA Ticket - Help!!

Hi all,

First time that I have received a ticket from APCOA for stopping at a roundabout at Luton aiport for less than 2 minutes! I only stopped because I was confused about where the dropoff point was - the car was still running and I had not blocked any traffic.

I wrote to them after I received the first letter and then they sent one back with 'photographic' evidence and rejecting my claim.. even though I had not realised it was for 'stopping' at the roundabout...

I have drafted my second response.. could someone please take a look an advise!

Dear Sir or Madam,

You issued me with a parking charge notice on 07/02/2012 for '01-Failing to park in a designated parking area' on the 09/01/2013 but I believe it was unfairly issued and I will not be paying your demand for payment for the following reason:

Quite simply, you have got it wrong and the vehicle was not parked inappropriately as mentioned in your notice letter.

The vehicle was parked in the priority set down area where the fee of £1.00 was paid.
If needed witness statements can also be provided as proof if required.

I believe there are number plate recognition cameras that record vehicles entering and leaving this area which will also be proof of this.

I will also be contacting Luton Airport regarding this matter of incorrect parking charge.

Please provide full photographic evidence of this alleged contravention.

If you choose to pursue me please be aware that I will not enter into any correspondence and this will be the only letter you will receive from me until you answer the specific points raised in my letter and provide the evidence I have requested.

Dear Sir/Madam,

In reply to the letter that was sent in response to my clarification of events, I would like to point out some of the baseless assumptions you made in regards to this “Alleged Contravention”.

In the letter you mention that I “stopped” my car on the roundabout, but you fail to address the matter that the car engine was still running, and the photographic footage does not show me dropping off or picking up a passenger, so your claim is illogical and unjustified. You can clearly see that the passenger in my car did not release her seatbelt, or make any action that suggests she intended to leave my car at that point.

The reason my car is still (for much less that the alleged 2 minutes you claim), is purely because I was confused as to where I should be going, due to the unclear nature of the car parking facilities. And it is also clear from your photos that I was in no way blocking any vehicles, as there were no vehicles behind me.

Further to this, I than drove to the drop off area, where I paid the correct free, for which I have proof (as mentioned in my previous letter) and my passenger who is a witness. Again, this makes your claims completely irrational and somewhat ridiculous.

Therefore I will not be paying this charge and I will not enter into any further correspondence with you.
