Another DRO-related credit report question

Hi,

A debt collection company (who apparently purchased one of the debts on my DRO - from which I'd already been discharged) did a Callcredit credit check on me a month or so ago.

At this time I'd already been discharged from the DRO, although still appeared on the Insolvency register, as it was within three months since the DRO ended.

When performing the credit check (which is listed on the report with the purpose of "Debt collection") would this company have been able to clearly see that I had been subject to a DRO?

Looking at the report, I can see that under "Public information" my DRO is listed there in the "Bankruptcies and Insolvencies" section with its case reference number and the status marked as "Discharged".

By carrying out the credit check on me, would this information have been clearly available to this company? (this is what I'd specifically like to know).

    I cant post links as i am a newbie but this is taken from the experian website. Someone asked can a debt agency run a credit check for debt collection purposes.


    A company must always get your permission to check your credit report. When you apply for credit you will usually consent to the lender checking your report at various stages in their relationship with you; including at the outset to help decide whether to grant credit in the first place, and then on an ongoing basis to help manage your account while ever you remain a customer. Importantly, if a debt is sold on to a debt collection firm, this consent stays with the debt. This gives the collection firm the right to access your credit report to assess your overall financial situation and to make appropriate decisions about engaging with you and collecting the outstanding balance.

    Thanks for the reply. The company in question has already made the next move, so to speak.

    Could anyone please tell me if they will have definitely been able to see the information about the DRO when they did the credit check? I need to know this before I take the next step in sorting this out.

    They can see ALL information that is there to see so if the DRO is on your credit report they would see it.

    Did you include the debt in question in your DRO? If so theres nothing they can do about it. If they contact you just give the info re DRO and tell them not to contact you again. If the debt wasn't included in the DRO you are still liable.

    Im by no means an expert in all this but i have built up a huge file full of info to help with my DRO process

    Yes, the debt was included on the DRO. I'd already told them not to contact me again, only to receive a letter requesting various details about the DRO, despite the fact it seems they already knew about it from checking my credit report.
