Parking Fine for parking in my own space!!

    You are right in that I have made a few assumptions around the lease. We'll have to await the OP's update once the lease has been checked up on.

    I fear that, as ManxRed says, a tenancy from a leaseholder won't give the answer as it is the lease from the freeholder that generally contains the sort of wording ManxRed is referring to.

    But as I said, with the 2 leases I read only last month, the management company is appointed by the freeholder and the contract with the management company's appointment - remembering that these often pre-date any lease with the leaseholder - give them quite a wide authority covering service charges, rights of management etc.

    A check with the leaseholder or even a chat with some neighbours may help shed some light on the arrangements and, as was the case with my friend who had mislaid her lease and agreement with the management company (sometimes separate contracts), a neighbour let her copy her documentation.

    Try Googling your exact title sentence plus the word 'private' and you will see LOADs of forum threads about fake PCNs in a person's own space. I have read cases on here before with the exact same title.

    Ignore the fake PCN, or appeal it and then appeal it to POPLA if in England/Wales.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    I don't think I can get a copy off my landlord, he doesn't tend to reply very quickly, or at all lately. =/

    OK. Can you ask the management company if they have a copy of their contract with the leaseholder? They may oblige. Failing that, try a neighbour.

    But don't worry too much. You can always ignore!

    Well I got a letter back saying they'd rejected my appeal of course. But they've reduced the charge down to £15, not the point I'm still not paying! They've issued me with a POPLA appeal form but think it would be better to ignore?

    Back to the thread title - they are trying to impose a fine on you, but they have no legal power to do so.

    You should try charging them with extortion.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I'm not sure what to say in an appeal. Saying the amount is too much never seems to work from what I've read in these forums. Even though they have lost NO money whatsoever from me parking in my own damn space!! Or even if it hadn't been my space, they STILL wouldn't have lost money because its free to park there!!

    Personally, I wouldn't bother and just wait for the chain of letters to filter through your letterbox ignoring each one.

    Well we and pepipoo.com can help you with an appeal if you wish, it's entirely up to you as it does require more time. One thing I do know that the company would have to be mad to take it to court, taking basically the leaseholder or leaseholder tenant to the small claims would be thrown out IMO there can be no loss
