Confused.....

Hi All,

This case has been dragging on for some time now so just wanted some advice really. Total Parking Solutions have tried to extort money out of me for parking in Halfords Carpark back in October 2012. I wrote back to them saying their system is at fault as I came into the car park twice but they have me down for one long stay over the time limit. They said if I want to appeal I need to go down the road to POPLA. They sent me a form with a verification number printed on it. I thought what the heck I will appeal anyway.... I then got a letter from a debt recovery agency saying I need to pay or else... I wrote back to them telling them very politely to sod off as I am appealing to POPLA and they have jumped the gun so to speak. They wrote back and apologised and said they will follow it up with TPS.... Now in MArch today I get a reply from POPLA saying they I cannot appeal as the verification code is wrong.... and I need to get a correct code from TPS... so they are returning my original copies!
So where do I go from here?? I am not going to pay anything unless a Judge tells me too... Will be invited to attend court if it gets that far?

Needless to say i am keeping all correspondence!

Any advice welcome.... thanks!

    Trust me, they won't want all this put in front of a judge.

    You could write back to TPS and state that their code was incorrect - they may give you a new one, and if they do come back here for advice on what to put in your appeal - we have a few good 'uns.

    Or you could just ignore them from now on, as I say they won't want this in court, they'd get laughed out of it.

    Good suggestion. Or you could wait until the period for supplying you with a valid code expires, then get back to the PPC, along with the rejection letter from POPLA telling them that they had failed to supply you with a valid POPLA code within the allotted time and they can now whistle! This should keep the debt collectors at bay.

    This assumes of course that you didn't quote the wrong number to POPLA. !

    Considering they have 35 days from the original appeal to supply a correct POPLA code, we can only assume that time is long gone.

    Thanks for the advice.... The code was already printed on the Appeal Form that was sent by them by email.... So I just filled in the blank spaces and sent it by email to POPLA.

    So being as all this time has passed since I sent off the appeal etc and I have not heard any other information from TPS then I would assume that all might have gone quiet. But where do I find information about time limits etc.? And what is PPC??

    Time limits - read the BPA code of practice on the BPA website.

    PPC = our shorthand for 'private parking company' on every thread on this forum. There's a sticky thread very near the top of the parking forum explaining abbreviations.

    Do as advised and tell TPS they've failed to issue a valid verification code before the end of 35 days since they received your appeal - so it's game over for them and any further communications will be considered harassment and reported to the BPA as a Code breach.
