Selling Privately in Scotland

Hi All,

When selling privately - is a Home Report required?

I'm looking to sell my place to my sister and brother in law - we have verbally agreed a price, they know the place inside out and I have physically shown them any "problems" which they were not concerned about.

There is nothing structurally wrong with the place, there is no damp.

They plan to rent it out.

Can anyone suggest a good/cheap solicitor? Or is it a case of just phoning around to get some prices?

    You don't need an HR. an HR is only required when you make it known to the general public, by marketing or other means, that your house is for sale.

    Nobody here knows which part of Scotland you're in, so no value in recommending a solicitor in Stirling, say, if you're in Peebles. Phone around your locals who routinely deal with house sales, and hire one on a 'conveyancing only' basis.
  • Homebuyer report is no longer a legal requirement plus given you selling your home to your siblings it definitely will not be the case. However, they may take it upon themselves to have a Home report done in order to highlight any environmental or structural issues with the area itself e.g. if the land beneath is clay, which would the property prone to flooding in times of heavy rain. In terms of solicitors, it is best to look around. Price is not always the key qualifier, but the quality and speed of service. I would recommend you ask for a local recommendation e.g. an estate agent you can trust. Although be aware that they may not provide you with an objective view on the best solicitor to use.

    Help4UKHomeSellers - If you don't know your Home Report from your HIP, don't try to tell us it's 'not a legal requirement' ....

    HIPs were discontinued a few years back.

    Home Reports weren't.

    Itt may be a private sale but is a mortgage involved? If not then things are a lot easier. There is not even a legal requirement to instruct a solicitor. Now THAT is a strain on family relationships
