Letter idea, inviting comments.

Following a discussion with a house mate who has received some 80GSM toilet paper from Euro Car Parks, I came up with the following letter; with the intended purpose of ceasing all correspondence from a PPC quicker than ignoring them.

Obviously, the best course of action is still to ignore them, but it would be nice to see some commentary and discussion on the following template:



RE: <Reference Number>

Without Prejudice. All rights reserved.

This is not an appeal.

Dear <Private Parking Company>,

I acknowledge receipt of your letters regarding the above reference number. I am the registered keeper of the vehicle in question.

I hereby deny any debt to your company and will not make payment under any circumstances.

Although this is not an appeal, I understand that under the Protection of Freedoms Act, if you do not find my response satisfactory; you must refer this case to the Parking On Private Lane Appeals board (POPLA) at a cost to yourselves of £27 + VAT. Should you choose to take this course of action, I reserve the right not to consider the outcome of POPLA’s assessment.

Be advised that any further correspondence from yourselves may be considered to be unlawful harassment and reported to the relevant authorities.

    Nothing wrong with that, just added a little for you
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Well here is the relevant section from the POPLA site.

    Who can appeal to POPLA?
    Anyone can appeal such a parking charge notice providing they follow the process below. If you want someone to appeal on your behalf, such as a family member or friend, they can do so but there can only be one appeal for any one parking charge notice.

    When can you appeal to POPLA?

    You may only appeal to POPLA after you have made your case (‘representations’) to the operator who issued the parking charge notice and that operator has rejected these and issued a POPLA appeal form.

    For details on what to do when you receive a parking charge notice, see our section on this website.

    If your representations are rejected and you do not then pay the parking charge but want to appeal against the operator’s decision to POPLA, you have 28 days to do this. If you do appeal to POPLA, which is independent of both the operator and the BPA, an impartial Assessor will consider your case.


    If your representations are refused, the person to whom that rejection is sent then has 28 days to:

    pay the parking charge; or
    appeal to Parking on Private Land Appeals (POPLA)
    If the parking charge is not paid or an appeal is not made within the 28 days allowed, the operator may take steps to recover any amount outstanding through the county court.



    Well that seems to suggest to me that YOU and not the PPC need to appeal to POPLA, so the bit in red in your letter may not be correct. You should be saying that YOU may wish to go to POPLA and require a number.

    Also, don't see why you need to state the obvious that you don't need to abide by POPLA's decision.

    I could be wrong, but can you find anything that says that the PPC can instigate the POPLA process other than to issue you with a POPLA number??

    Oh, nitpicking, it should be "Yours faithfully" as it is not to a named individual and the "faithfully" (or when correctly used, "sincerely") should not have a capital "f" or "s", but if you want it to look very professional, then detail is important.

    A longer in-their-face challenge about the legitimacy of the 'ticket' without making any actual appeal nor even divulging who was driving, is here on pepipoo which is also a good idea for a letter IMHO:

    Nice. As long as the people using this challenge do not repeat that for POPLA - need a proper and details appeal if the PPCs want to fund a POPLA decision, may as well make it a winning one for the driver!

    Along the same line of thought as Guy's Dad - you are saying that it isn't an appeal but at the same time telling them you will go to POPLA. You cannot go to POPLA unless they reject your appeal, so I cannot see that bit working.

    Ok, well thanks for the comments. Evidently it falls through on POPLA's rules by not being an appeal in the first place.
