had a response from my company today, they've said they won't over turn their decision so I can now take it to the Ombudsman, which I will. They've also offered me some compensation as a result of their poor customer service. Nothing ventured, nothing gained.
  • Go for it, you have nothing to lose.

The lack of diligence from Diamond is no surprise. There is a massive assumption that the merest touch from the rear opens the chequebook for a PI claim. Diamond then take the line of least resistance and the time and money to validate a claim is just not worth the expense.

I doubt you will persuade the FOS that it was a fraudulent claim but I guess they could get Diamond to compensate you for their incompetence.

You could specifically ask the FOS to get Diamond to reopen their investigation if you believe they have ignored some key evidence.

Also, if you are convinced the claim is fraudulent and perhaps damage to the other car was added after the accident then phone the Cheat Line on 0800 422 0421
Mr Straw described whiplash as "not so much an injury, more a profitable invention of the human imagination—undiagnosable except by third-rate doctors in the pay of the claims management companies or personal injury lawyers"

Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
