    Did nothing come up in your structural survey about this? You might also have a claim there.

    Steve_f.....can't you see that this is what virtually everybody was saying? Albeit with a slightly different ending.

    That you ( most likely) WILL win the case, that they will make life TRULY hell for you and your kids because... it may just bankrupt YOU.

    THAT'S the pivotal point. Not whether the prior owners were deceiving schmucks who got away with it. Who may or may not plausibly argue in due course that they never used the garden or shed much anyway and weren't aware of the extent of the problem. Or who knows what they will argue. The only thing certain is that it will be diabolically costly to involve lawyers.

    Do yourself and your family a favour and move on. Fix the flooding problem and put it down to one of life's unpalatable and expensive lessons. As a result you will be incredibly vigilant on your next property purchase....and who knows how much money that will save you then.

    Why can't the OP submit a MoneyClaim online, the claim is less than £5,000 and it sounds pretty clear cut? OP gets statements from the neighbours stating the "property" has flooded many many times, a report from an independent drainage expert, and 3 quotes to repair the issue then submits the forms online. I don't see that resulting in bankrupcy.

    Simple drainage problem, a couple of trenches filled with gravel and re shape the top soil over the top.
    Let it run elsewhere.

    I've just found myself in exactly the same situation as you (though when we saw the garden it wasn't flooded).

    since moving in with the bad rain our garden has been flooded 3 times badly already, due to rainwater run off from the neighbouring school field into what is probably a filled in dew pond. The level of water means that we are at risk of the damp proofing on our house being impacted and the brick wall holding up part of the garden will need replacing (as it was already damaged due to water pressure of holding back all of this flood of water).

    We are now looking to pursue the surveyor (who mentioned the cracks in the wall but neglected to mention the cause, but did mention potential flood risk in garage which was absolutely fine) and the seller (who clearly lied on the form), and I wondered what happened in your case, and whether you have any advice.

    Considering this thread is nearly a year old and Steve_F hasn't returned with an update since then you're probably not going to get a response :)

    Sorry to say I have done nothing in the intervening time. I haven't got past the hurdle of not knowing the sellers full name or address.

    The garden still floods, more than ever in the current weather.
