    Ebay have checked and approved this policy. We have a clear returns policy that is made available when you purchase any item from us. You accept the conditions of purchase
    when you buy any item form us. It may seem that we are profiting from this return policy but you have to consider the following:
    1. The item needs to be picked and packed. 20min
    2. Time taken to deal with the messages for any query and subsequent resolutions for a return or refund. 30min
    3. Process refund 10min / exchange 30min
    4. All postage and packing are paid to royal mail. We do not profit on postage like other sellers.
    When you calculate the cost you will realize we actually make a small loss.

    Did you send item back tracked? If so, go to Paypal, file a dispute under 'Item not as described" (If the sizing is wrong then it's not as described) and wait.
    When you are asked to return the item input your tracking number and they should find in your favour giving you 100% of the item cost and P&P (Not your return P&P).
    Then leave a factual Neg along the lines of "tried to charge restocking fee on faulty item".

    Hi,

    I've opened a 'item not as described' case with Ebay and input that the item has already been returned and partially refunded less P&P and the 10% restocking fee. Not sure how this will go as I returned the item via ebay's process (sent recorded) as directed by seller.

    The problem with ebay is that it doesn't have a system for implementing DSR, In this case the item is not faulty, and sizing is a very grey area (there are no agreed standards) so it would be difficult to argue that the item is not as described under current consumer legislation.
    The real issue is DSR and the illegal return policy. If ebay had a way of enforcing that it would be ideal. Failing that a SNAD cliam is the nearest thing and I agree the OP should do that.

    I think it's important to point out that SNAD should not be used just because something doesn't fit, unless the item is labelled a different size, or if it's clearly wrong (as in at least 2 sizes difference). In the case of private sellers they have the right to refuse a return just because it doesn't fit.

    What business sellers don't seem to understand is that they have to take into account returns in their pricing, it's their fault if they lose money. Incompetence is not excuse for acting outside the law.
    And also DSR are actually beneficial to them because it helps online sales as people are more likely to buy if the know they can return the item.
  • Have referred to trading standards as this seller has 1200 listings all (at least the ones I checked) subject to this charge.

    Not good enough.

  • Good lord, a restocking charge of 25% for a £975.00 engine is outrageous! It reflects really badly on ebay that they don't police their sellers better.

    Did you tell him youre returning it as it was misdescribed?
    Don't mess about just send him Letter before action & wse money claim on-line also add 5% because of disapointment and stress.

    I imagine that it's seconds that he's been selling, lesson learned, I'll stick to M&S/Debenhams in future. It is a UK seller, I just have issues with paying someone to bung something back in their box room.

    Seconds or Asian sizes, there is a cash and carry in Glasgow that has asian sizes and they are often 2 or more sizes down than our sizes.
