Do I have any comeback on Broker ....

I bought a motorbike, new, in 1999 - had it MOT'd continuously from then until Nov 05 - work commitments kept me away from home (Jun 05 to Feb 06)and I was unable to use the Bike. When the tax expired in May 06 I took out a SORN as by then I was overseas with my job.

When I renewed the insurance in Nov 06 I informed the Broker of the situation - and as I was overseas I stated that I would be continuing with the SORN until the end of it's validity at the end of Apr 06, at which point I would be home-based again and would be MOT-ing and Taxing the bike.

The Bike was stolen and burnt out on Friday 13th April!!!!!!!!

The Insurance Company have written so say they have the Engineer Report and they have assigned a pre-incident value of £1,800 to the bike.

However, they have just phoned to ask where the MOT certificate is - although I had explained all this in my covering letter to them when I sent all the paperwork requested - I explained the above facts.

The Insurance Company now say they need a second Engineers Report in light of the fact that the bike was not MOT'd. I explained that the reason for no MOT was my absence from UK rather than the condition of the bike (a new set of spark plugs, a flush out of fuel and a charge of the battery was all that was needed to MOT it).

They say the reason for no MOT is not relevant - and actually the terms of the policy state that the bike must be MOT'd at all times, even if SORN. This was not pointed out to me by my Broker even though I informed them of the facts on renewal.

If the Insurance Company reduce the value of the bike because of the situation with the MOT will I have any comeback on the Broker who should have sold me a policy that met my stated circumstances?

I suppose they are bound to reduce the value in light of the MOT situation??
