ltsb unreasonable

5 years ago i had account maintenance charges on my account after going overdrawn whilst in debt management,i tried to get them to give a temp overdraft this was declined ,i tried to pay £15 /week if they could stop charges they declined ,eventually i had to add it to my debt management plan ,it was now £840 ,i then paid through dmp, unknown to myself due to months of problems with mail in our street i found out that they had defaulted it ,i had not received a pre default notice due to mail probs ,mail probs were so severe for 4-5months that a neighbour was deported due to falling out with people from the other street that was also having mail probs.i tried to explain the situation but their attitude was we posted it and would not resend a pre default letter, last month i wrote querying the charges and default ,they are willing to give me £450 off the charges but nothing on default ,so they are giving me a refund of more than 50% of the charges but wont look at the default ,who can i write to at ltsb who is higher than a customer service consultant ,i tried a customer service manager but the consultant answered .any help would be appreciated .To me it seems very harsh that after 5 years they now give me more than 50% of their charges but they dont see how they should ammend the default

A record of default is a factual event. Even with a goodwill gesture of 50% of charges, the default happened. Normally, you would only expect a default record to be removed if there was an error by the bank.

The complaints team is the one that makes these decisions. Is that who has refunded 50%?

The complaints team is effectively the end of the road as far as the bank is concerned. After that its the FOS. However, as it is a goodwill gesture and a default did occur, it would be hard to see why the FOS would overrule the bank when it is a factual position and no wrong doing by the bank has taken place.

To be honest a goodwill gesture is like giving me a slap in the face ,considering all i asked for intially was a temp overdraft of £150 and i would have repayed that over 3 months and i would not have ended up with £750 of account maintenance charges or a default ,so an offer of £450 5 years later does not make much difference.

a bit of research and a bit more amo to fight the default, according to ico guidelines defaults should be listed between 3-6 months when accounts/payment are not nade, why did ltsb wait nearly 2 years?
