can i get my deposit back from a car dealer

hello i went to see about the peugeot deal just add fuel. all seemed well so i put a £400 deposit down. they said the car would be here for the 22nd of march. but i got a phone call today to say that the colour i ordered which is the basic white one will not be in stock for another 6weeks after this date.and they keep trying to fob me off with other colours is their any chance i could get my deposit back and cancel my order as i am starting to get pretty sick? cheers

You can ask for it back, but a 6 week wait for a new car is not that bad. The contract you signed probably states that time is not the essence of the contract. Does it really have to be white car - they are a pain to keep clean."You were only supposed to blow the bl**dy doors off!!"0

well its our lass whos twisting but it would of been a 10 week wait in total. i think they are trying to get us to have a car they already have on site because the registration change happens this month.0

You maybe able to after the 22nd March, they have until then to supply as per your request.
As the poster earlier mentioned a few days for a new car is very swift, often they can be 3-9 months for new build.0 -
could turn this into your advantage, they have no white cars, metallic is extra dosh you see! and if they are offering a car that has metalic at no extra cost why not go for it as long as its the exact vehicle you ordered appart from colour. BTW the pug white is horrible for chipping, shows every imperfection and also extremely hard to keep clean.0

I would very much doubt its worded into the contract that it will be delivered on or before 22nd March, therefore its unlikely the O/P could ask for a refund based on not delivering by that date.
Usually there will be a clause in the contract around delivery and it will be worded accordingly to allow for slippage.0 -
Is there any real point in cancelling, assuming she wants a white Peugeot then its not likely another garage will give a better delivery time. I know its a drag waiting, I remember us waiting for my daughters Pug, but its worth it. Regarding the other colours it strikes me they were embarassed and wanted to offer an alternative.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0
