car accident and claiming

Hi Everyone,

In January 2011 my husband an myself had an accident, which was his fault. his steering wheel locked when coming round a corner on a hill and we hit the back door of a classic merc. We passed on our insurance details to the other driver and we got a phone call from our insurance (Eldon Insurance) asking what happened and if he accepts liability, which he did.

This is the last thing we have heard, we have had nothing to say how much the claim was for etc. We are now with another insurance company.

Just recently we have been told I should have received money for the accident because I was a passenger even though I wasn't hurt and we wasn't fully comp, also that we should have got papers to sign before a claim was paid out and definitely received papers to say how much the claim was for.

My Husband is going to try get in touch with our old insurance company but wanted some more information on what we have been told, can anyone enlighten us please?

    Who told you?

    If you werent injured then you cannot claim. If you were injured then you could have sued your husband.

    Sounds like typical fishing stuff where they claim your owed thousands when they have absolutely no knowledge at all

    Just told by who?
    A random phonecall perhaps?
    Basically, you will be claiming off your insurance to recompense yourself.
    These outfits that call you get £750 per lead and will tell you anything they want to get you to persue a NWNF case, they get their money.
  • yes it was cold callers that told me which was the reason for me doubting.

    Should have we received paper work for the money they paid out to the other driver? this is my main worry because when we look for new insurance some companies ask us how much the claim was for.

    You would not normally receive paperwork to sign before a claim is paid.

    Bear in mind the people who called you are paid by commission and have no knowledge of Insurance and little knowledge about injury claims, they just need to be able to sell. As you've discovered they will tell you anything to get you on their books and were happy for you to lie that you were injured.

    If you want to know how much the old Insurers paid out, give them a call and ask them.

    Sadly these clowns will continually call, someone had run into my car a couple of years back, I didn't persue a PI claim, they keep ringing, with" there is money set aside", I tell them to just forward the cheque, the last call they were saying now that I can claim for loss of value on the car :eek:

    "Shock and upset" is an injury claim, its just psychological injuries rather than physical.

    Insurers do "set aside" money, aka reserve, on all claims but that is based on the information that is to hand. If your hubby said that you were a passenger but were uninjured then there would be no reserve placed. Irrespective of if there is a reserve or not however the amount settled is neither governed by the reserve or restricted to it.

    For example, back in my claims days we would reserve as standard £1,250 for PH car, £1,000 per TP car and £5,000 per TP that we believed was injured. If we then review the case and see the TP was in a Audi R8 and the PH said it burst into flames afterwards you'd adjust the TP car reserve to £75,000 or so. Likewise if someone was cut out of a car you increase the injury reserve. If you then receive a letter saying they are just claiming whiplash you reduce the reserve down again.

    Technically the insurers do put the money aside but it is simply an estimate and insurers not only estimate on the claims that have been registered but also those that havent even been registered yet (IBNR)


    The call is from a pure cold caller. They will know next to nothing about any incident and are simply fishing. Their questioning techniques are intentionally designed to misleading you into thinking they do know about a specific incident and have most the facts about it but really they are getting them all from you in that call.

    Any passenger of a car can always claim compensation for injuries from someone who's at fault (the driver, their insurer, or the MIB under the uninsured or untraced drivers agreements) with very limited exceptions. This applies even if the passenger owns and insures the car involved.

    But were you actually injured?
