Appeal to PPC letter Aldi car park

received a parking charge notice from parking eye i was 10mins over the time. they included a leaflet 'Protection of Freedoms Act 2012

letter included photo of my car arriving and leaving with the time.

ive received some very helpful advise and decided to appeal. Ive pieced something together from snippets of various letters on this site and others.

some views on my letter before i post it would be appreciated.

Dear Sir/Madam

Today, xxxxxxx, I have received from you a parking charge notice ref xxxxxxxxxxx for an alleged overstay at site Aldi xxxxxxx. May I request that your charge be dropped immediately as it is clearly a penalty and no representation of any losses suffered by the landowner.

I also deem the amount to be an unlawful penalty clearly designed purely for Parking Eye to make a profit.

If you do not cancel this charge with immediate effect then please send me a POPLA verification code. I also request that you provide a copy of your contract with the landowner as evidence to prove that you have the authority to issue parking charge notices.

I would also like to point out that nowhere on your signs in the aforementioned car park does it state that my car details would be recorded and that they would be used to gather my personal information from the DVLA.

If I do not receive a POPLA verification code from you within the next ten days then, as per the BPA code of practice, I will deem this ticket already cancelled.

    I wouldn't even write to them. Save the cost of a stamp. I would simply ignore it.

    Nope they must respond within 14 days initially, and either accept or reject your appeal within 35 of days of the date of your first letter. So the CoP is quite clear on that, so amened the letter accordingly

    If you receive a challenge or appeal about the issue of a parking ticket, you must stop work on processing the ticket immediately. You must not increase the charge until you have replied to the challenge. You must acknowledge or reply to the challenge within 14 days of receiving it. If at first you only acknowledge the challenge or appeal, you must accept or reject the challenge or appeal in writing within 35 days of receiving it. We may require you to show that you are keeping to these targets

    ...and bluealpaca knows that we advise POPLA to be used, that's what this is about. The initial appeal to PE can indeed be as simple as the one above (but the appeal to POPLA needs to be much stronger in due course).

    The only change I would make, bluealpaca, is you say '10 days' when in fact PE have to accept, or reject with POPLA code, within 35 days of receipt of your appeal. But in fact I would not tell them that! I'd just remove the last sentence and send it off.

    Make sure you come back for help to word a strong POPLA appeal as you'll need stuff about the lack of ownership in the car park by PE.

    I would leave that in myself coupon, because it tells them in no uncertain terms that you have read the CoP and understand that popla is the next step. The reason is to get them to cancel it, I know getting them to pay to go to popla is good, but its not about that IMO it's about winning with little effort. In poker it's called a bluff and its objective is to induce a fold, but knowing that you have an ace up your sleeve if they don't.

    Yep, bluealpaca could leave it in but would need the right 35 days time frame stated so the appeal looks as if it's from an informed person who could win at POPLA (which it is!).

    The clock is ticking from the date of the appeal, so providing you can prove its been sent its from then, so send it (email) on a Friday evening and they already lost 2 days if they are working office hours only lol .

    If you keep a calendar just note the timeframe they operate within, I wish I could get a ticket, no sod is ticketing me despite breaching a few of their rules.

    I did wonder about the last sentence of my letter and wasnt sure how much time they have to send me the POPLA verification code. As its 35 days ive decided to remove that last sentence cos they have got plenty of time to respond.
    I am also going to post it rather than email. I just personally feel this keeps them more at a distance and it will take them longer to reply if they cant flit an email back to me. Therefore wasting more of their time and money!! Ha ha!

    Shouldn't think so, the GloveBox Parking Guide isn't something we really look at here as it was never great, a bit like all the old articles on parking - not good.
