    it does if the s75 goes wrong. who is the OP going to sue with no accurate address etc.

    That was my point, even thinking about suing a closed down car dealer for £200 with significant doubts about their company status/address/vat number etc is a waste of time.

    S75 is the only way to go

    Then op can sue the credit card company whom are also legally liable for their breach of contract

    If the s75 claim fails then so almost certainly so would any claim directly against the company (if it could be identified).

    In the circumstances described, the only possible reason a s75 claim could fail, but a claim against the company would succeed, would be if the purchase price was over £30k (which seems very unlikely).

    Just go s75 and let the credit card company try to find the merchant. The credit card company and its agents (i.e. another VISA or Mastercard member bank) are the ones who gave the dealer the merchant account. You are not under any obligation to contact the dealer directly, although it will look better in court of you can demonstrate that you've tried.

  • In February I purchased a vehicle from the very same dealer. On the day I went to view the car the salesman made out that the showroom was having some work done and that the forecourt was being tarmaced. I decided on the vehicle. He told me that they didn't have the V5 for the vehicle yet so couldn't get it taxed for me until it arrived, sound familiar? He claimed the logbook should arrive by thursday. On the thursday the logbook had miraculously just been received so I could pick the car up. When I arrived the forecourt and salesroom had been completely emptied apart from my car but they kept up the story about renovation work. The car had been for its MOT that morning so the only thing left was to get the vehicle taxed. I gave the salesman the £110 to go and tax the vehicle for me and all seemed fine. That was until I today received a letter from the DVLA telling me that the tax applied for in my name before I had even signed the logbook will be void unless I pay £110 again as the cheque they paid with has bounced.

    They knew exactly what they were doing. They were in the process of doing a runner whilst signing the car over to me and paid for the tax with a cheque they knew was worthless whilst pocketing the cash I handed over for the tax that morning!
