Hi All,
Not sure if i am digging for a bone that isnt there but ill tell the story anyway. Back in 2010 i decided to change my car. We spent some time looking around and finally found the one i wanted that i could afford. We went and had a look at it and fell in love immediately with it. We bought it and from there on in regretted every minute. We bought it from a small trader local to us who offered us 12 months warranty. We paid on a debit card as we had savings in our account. Within a couple of weeks it was back in for bits and pieces and then things really went wrong. The engine started rattling and after checking it was the tappetts. The garage repaired this FOC but for some reason it took then over 8 weeks to do it, in th emeantime i was paying for buses and taxis as they didnt offer courtesy cars. There were numerous problems after that until the clutch started to go about 4 months on. It went back to them and after about another 4 weeks i had it back. Apparantly the clutch was just dirty and had some oil in it and they had cleaned it up. Well it didnt really make any difference so i dorve it for a couple of weeks and it got to a stage where i couldnt drivie it anymore. I went back to the garage but it looked like they had shut up shop and disappeared. I now had the dilema of whether to replace the clutch myself or sell the cra for next to nothing and lose alot of money. I eventually found a credible company to do the work for me and they gave me a very competative quote. They had the car in and the next day i had a very concerning phone call from the garage. The manager was very very apologetic and proceeded to tell me that the car was an absolute mess underneath and alot more work was needed. It wasnt just the clutch, it was alos the gearbox, transfer box, drive shaft and a few other parts All in the bill went from £700 upto £3400. This was around what the car was worth so i either way i was going to lose money. Either scrap the car as it wouldnt have been able to go back together to sell, or get the work done. I opted to get the work done and tried to get hold of the garage where i bought the car but no matter what i couldnt get hold of them. I sold the car on fairly quickly as i knew this wouldnt be the last thing to go wrong. All i was around £4000 out of pocket. It has now come out this week that the owner of the garage where i bought the car has been sentenced to 16 months prison due to fraud and theft and has had alot of other cases very similar to mine. Is there any kind of claim that i can make against him now that he has been found and already charged? I would love to get one over on him like he did to me.
any help you can give would be great.

I think you'd be better off posting this in the CAB forum, it's more about civil rights by the sounds of things. I don't think there's much you can do besides try to bring a private prosecution or small claims court claim. But CAB or people on those subforums can offer some solid advice."The only man who makes money from a gold rush is the one selling the shovels..."0
