Penalty Charge Notice

Got back to my car today and found a penalty charge notice on windscreen.

I had displayed a Residents Visitors Voucher on dashboard with my Reg.No. also day and date scratched off, but had not scratched off the month.

Anyone think this is worth appealing against? Anyone else done this? I think it is extremely petty.

As the date is the 9th and the day is Wed. it is obvious the card was not used before, as there is not a Wed on the 9th since last Sept. and the area was not a voucher area then.

    Definitely appeal, chances are you'll get away with it.
    Whether you choose to rub the month off and send the voucher in with the appeal saying that the attendant must have missed it is another matter. I guess it depends if the reason for the ticket was given as "motnh not displayed" or not. Honesty is probably the best approach and I can't see any reasonable magistrate finding against you, should it go that far.

    Take my advice Serene check the details on the pcn very carefully. I was issued
    with a pcn which had the colour of my car wrong,my car is red,the ticket stated
    silver.I successfully appealed and the pcn was withdrawn.Truth and justice 1 Traffic wardens 0. All details on a pcn must be correct so given that many wardens issue tickets quickly there is always a chance they will make an error

    But were you actually parked illegally?
    No reliance should be placed on the above.

    I was parked illegally the point being the law applies to all If a ticket is issued it must be issued correctly if not we probably would not need lawyers.Imagine a world without lawyers.Stop cheering

    I appealed, stating I was legally parked with a legal visitors permit displayed, but due to my error had not scratched the month off.

    The reply was the permit was not correctly validated,so I still have to pay the charge.

    The annoying thing is they are right, but in my opinion very petty, I could appeal to the National Parking Adjudication Service (NPAS), but was told the Adjudicator will apply to the rules, so looks like I will have to pay the charge.

    The Adjudicator will also use common sense, I think there is a very good chance you'd be successful. The Adjudictor will see you've done everything required but made an error. You've paid the fee and are not trying to shirk the payment. That is not an excuse for an over zelous Parking Authority to exerted their jack booted mentality on you. And, if you do appeal a lot of Parking Authority's will not even bother defending their action so you'll get a default result.

    I'd take this on not roll over to the heavy handed idiots who try and work on war of attrition and the publics general apathy in these matters.

    You are unlucky with the missing month but the law does work both ways.

    If you park on double yellow lines, but the council has forgotten to put on the T-bars at the end, then they are invalid. The council could argue that it was just an oversight and it was obvious they were double yellows but they will lose there case becasue the law is strict on that.

    It is not disimilar to your position - although the council does have the discretion to cancel the ticket if they want. I would guess they do not want to be in a position where some dishonourable people try to use the cards more than once. So harsh but fair.

    Regarding the person who appealed on car colour, well done but I am surprised it succeeded. The colour of the car on a PCN is not a mandatory requirement. This is logical if you think that at night it can be difficult to distinguish between a black, blue or brown car.
