can i accept a partial offer and contnue for the rest

Hi All,

Our bank has made an offer of £2020 in settlement in full and final payment of our dispute.

The total of our claims over 3 accounts is just short of £8000.

Can we accept this ammount as a part payment and continue through MCOL for the rest of the money.

If this is possable how do we do it and are there any templates to help.

This payment would really help us to move on as we are struggling to get together the £290 it is going to cost to claim the full amount.

    Maybe. However, do you have the money (cheque or credit to an account) or just an offer?

    Only an offer with 8 weeks to accept or case closed!

    Does it make a differance.

    Yes. If you've got the money, you can take it and run, as the saying goes. You then tell the bank that you accepted it "without prejudice" and take them to court for the rest. What can they do?

    With just an offer, you can tell them that you will accept it "without prejudice", but they would then have every right to say that this was unacceptable to them and withdraw it.
    The acquisition of wealth is no longer the driving force in my life. :)
