Divorce papers

Good morning,

I asked previously for advise regarding divorce proceedings and require confirmation for the following.

My ex-wife is filing the divorce papers and because she's on benefits she's going through a solicitor. I had planned to submit the paperwork myself so knew of the costs in advance.

I do not want to be paying for her solicitor fees, however, I don't mind paying for most or all of the court fees.

On the paperwork her solicitor has ticked under 'costs 9if you wish to claim costs from the Respondant or co-respondant)' the respondant shall be ordered to pay the costs of this application.'

Does this mean I'm expected to pay for the whole court application (£400?) and/or her solicitor costs?

It means they are hoping you will pay the costs, however you can appeal against those costs before they arise.

By costs do you mean the whole lot including her solicitors costs? I don't disagree with the divorce but I do disagree that she can say 'it's your fault' and make it grounds to pay for everything. I don't think she has any evidence to claim 'unreasonable behavior' on which she is basing this.

I've been sent a 'Notice of Proceedings'. Is this where I need to defend paying costs.

Do you intend to defend the case? No
Do you admit adultery? No
Even if you do not intend to defend the case do you object to paying the costs of the proceedings? ***Unsure of answer but I'll pay half the court costs **

Do you agree with the proposal in that Statement of Arrangements (children)? Yes. However is this a 'statement' or a legally binding agreement? I would like to change the agreement in the future so I can see my family.

Sorry for all the questions. Just need to know where exactly I defend paying the costs.

I think I've managed to get the information from wikivorce. I'm going to contact her solicitor advising I do not intend to defend the divorce but do defend allegations (which are unfounded) and agree to pay half the court costs if the claim costs are dropped.

Hopefully that will sort it all out. :-)

If she is on legal aid her costs may be awarded against you.
