OR update....

Hi everyone,
I've not been around much lately. Very busy with the kids, and OH has been at home on his computer so I can't get a look in even in the evenings! Tonight he's playing in a cabaret performance!
At 6pm this evening, just about to light the candles on my 5 yr olds cake when the phone rang.....the OR.
She just wanted to question a few things on our bank account.
In Feb we bought £200 of Ryanair flights, twice. We bought the first from Stansted, but it was so expensive for us to get there that we bought more from Bournemouth. We planned to reclaim the taxes from the first flight. Unfortunately Ryanair charge a fee for claiming the taxes back and the fee is larger than the eligible taxes.
The charge for transfering ticket to another flight is £30 per person per flight, so this was also ludicrus.
OR wanted to know why we had purchased these flights and had money on our account spent in Euros (with our Maestro card:rotfl: ) It was really embarrassing. I explained the above, and that my in-laws had paid for the accommodation. £200 for flights for 7 is not bad really, and we hadn't been away in 4 years. She seemed OK.
She then asked about a cheque for £5000 on May 10th. Fortunately I had been over this with the insolvency service. It was money from the loan for a car. We paid it into my mum's account for safe keeping. When we found a car in June. She paid for it and gave us the money left over back. I repeated what the insolvency service had said, that there were paper trails for all this info, and it could all be proved.
Again she said this was OK.
I am still shaking though. I am really worried. Really unnerving, out of the blue.

Hope you are all doing fine.

I know the feeling. I still can't quite get rid of the flinching every time a letter drops through the door, and I'm 7 months into BR. A call out of the blue from the OR would scare the ******* out of me

Yes. Puts a few things in perspective to think what they are going through. :(

Ok just when I thought I was coming to terms with what to expect that is a rather worryingly wrinkle... I don't think there is anything embarressing or OTT on our account but I really can't remember. Large withdrawls and payments here there and everywhere... geez... I can't remember what I spent money on last week let alone last year!

Don't worry. The OR is looking for any of this:
We cannot list all the actions that could be considered dishonest or blameworthy in relation to your affairs, but here are some examples the official receiver could include in his report to court:

    * incurring debts that you knew you had no reasonable chance of repaying
    * giving away assets or selling them at less than their value
    * deliberately paying off some creditors in preference to others
    * gambling or making rash speculations or being unreasonably extravagant
    * failing to keep or produce records that would explain a loss of money or property
    * fraud or fraudulent breach of trust
    * causing your debts to increase by neglecting your business affairs
    * failing to supply goods or services that have been paid for
    * carrying on a business when you knew or ought to have known you could not pay your debts

Unless you have a villa in Spain you don't tell them about, or a Ferrari hidden in the garage you will be OK.
They are very used to seeing finances that have simply become a little muddled.

Vixen, I was just wondering where you'd got to!

And fermi, thanks for posting that, I just went through my statements and apart from £84 on flights to Scotland last year, they are all pretty much cash and supermarket transactions.

  • My OR is being really hard. They phoned last week to ask for more information as they couldnt match up some transactions on a credit card. I can only assume this isnt a good thing

I almost wish theyd just get it over and done with. Having the prospect of a BRO hanging over you is becoming worse than the debt.

Maybe its just my perception of events, but i do feel my OR seems to be "looking" for it, and shaping things towards that, as opposed to finding out the facts.

I think theyre looking at a case of taking out credit without being able to pay, but thats such a broad definition. I didnt take out loans prior to BR or anything like that, but did borrow to make repayments when things got tough whilst making ends meet. I guess its how long they want to look. By definition i took credit whilst being unable to pay at some point as im now BR

Anyone else experience a tough OR?
