    'Managing Director', yes, and/or 'Company Secretary' if a Ltd company I think.

    And I would name the PPC 'Approved Parking Solutions' not just 'your parking agent' in case they use various firms in various car parks.

    A couple of typos, 'Berkely Homes, who i consider'' should be ''Berkeley Homes, who I consider'.

    And Harassment in 2 places is spelt wrong. << That's the right spelling.

    If you have received a fake PCN or several then you should spell out what you want them to do about it- e.g. ''cancel the attached (copy) fake PCNs this week, before the company start sending me any more letters, and call an extraordinary General Meeting within six weeks, with all residents invited, to discuss this farce and how to return any monies paid by victims.''

    Finally your final paragraph in a Notice Before Action should be timebound, so you need summat like 'If I do not hear from you within 14 days of this letter being received then I will file a MoneyClaimOnline small claim for at least my expenses, Court fees and at least {say} £250 damages for this harassment which is clearly designed to intimidate victims and impersonate real parking tickets. If more tickets and letters are allowed to be issued to me then the amount of damages claimed will be {say} £30 higher for each and every communication.'



    But I have to say you'll get absolutely nowhere with this...unless you are prepared to actually file a claim online.

    I agree. And it doesn't really look like a winner to me, I am afraid. No offence to Sandra, but I fear she would require a lot more experience or legal advice to put forward a decent case.

    And if she loses, then that's a few £££ down the drain.

    Personally, I believe in people power and, if sufficient other neighbours would play ball, then a letter to Berkley Homes saying that, unless they instruct their agents to stop harassing people who live there and their visitors and confirm that they will do so, a protest demonstration will be held by residents and their children on a rolling basis outside their show home, with the local paper and local radio/television news being invited to come along to report it.

    i rather like the sound of Guys Dads option... she was already talking about going to the papers, and putting anon letters through the doors of the empty posh houses that are still for sale, telling potential purchasers whats going on.

    they are all still very concerned about the 'ignore' option though. folk dont believe that if you ignore these parking company tickets, they will, eventually, go away. I keep telling them!!!!

    i think the letter threatening the protest is a sound one for now.

    The ignore option, to put slightly more substance to it, is as follows:

    1. These tickets are speculative invoices alleging that one private party owes another private party money, usually through alleging that the party has breached a contract.

    2. The only ultimate recourse to obtain payment is to take out a civil claim in the county court.

    3. In order for the claim to succeed, the private parking company must demonstrate a number of things:

    a.That they had actually formed a contract - their contract with the landowner must contain sufficient terms and conditions to allow them to do that.
    b. Also the signs - these form the contract acceptance - must be prominent, visible, and worded sufficiently. If not, then no contract has been formed and no breach took place.
    c. The remedy for breaching a contract, under civil contract law, is actual losses only. They must be able to demonstrate that the landowner actually suffered financial losses of £100 (or whatever it is) as a result of the parking incident. Note that if the recipient of the ticket was entitled to park there anyway then they are stuffed regardless.

    They will, quite frankly, struggle to achieve the above. They know this full well, which is why they very very very rarely try court, and why a good defence - available from PePiPoo - would see them off anyway.

    Hence they stick solely to sending scary threatening letters and hope you get so scared that you simply send them money. That's their entire business model in one sentence.

    When you don't give in, after a series of scary letters, they give up.

    End of scam for far more than 99.99% of people if ignored
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    ok. ive done a letter about the protest, but also holding them equally liable for the actions of their agents. and telling them that the tickets being issued arent legally enforceable. being sent to my daughter in law tomorrow so she can sign it. and shall await the outcome.
