these people went down the road my son lives in, on a small estate, adn ticketed everyone in the road at one am this morning!!!! the whole street got a ticket.. there are no yellow lines on the road, the sign in the road says 'parking in designated bays OR display valid permit' . they have a permit and were right outside their house. the person who did the ticket has even got the number plate wrong, theyve put an N instead of an M on the ticket.
do they have to pay this?? or is this one of those that they decorate the mantleshelf with??

Can you tell us who exactly ticketed your son, and I mean the precise name. Who is the appeals to? And who is the payment to ?
I just want to make 100% that the advice you receive is the correct advice. ThanksWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.

firstly what does it say on the ? ticket( penalty charge or parking charge) and secondly who is it payable to????0
-
approved parking solutions is the company. it says 'NOTICE'.
appeals and payments to them direct.
it also says, NOTICE of breach of contract to this car park issued by APS, agents to the owners. (it wasnt even a carpark!!) and theyve got a letter wrong on the number plate.
it says PCN then gives a ref number in the box.
the thing it was in says parking notice enclosed.0 -
it also says 'in consideration of which you have agreed to pay the sum of £100 or £60 if paid within 14 days of parking charge notice'
they also have a valid parking permit issued by the council which was correctly displayed. but dont know if these people are employed by the council or are just chancing their luck.
have also just been told that the builders on the estate, berkeley homes, are the ones who have got the parking company in.. but there is no more building going on, its all finished. they also say that they have been told by 'someone' that the road at the front of the house, where they were all parked last night and is between their house and the last building phase of flash houses, i private and out the back is NOT private. but there are no signs anywhere that say it is a private road.0 -
Who owns the road?0
-
Tell everyone in the street who got a ticket NOT to pay. Either way these tickets are legally unenforceable, however we may be able to stir up some trouble for them.
Firstly, as advised, phone the council and establish exactly who owns the bit of road where the cars were ticketed. Does your son pay the council for his permit? Is it specifically a permit for that road?Je Suis Cecil.0 -
dont know but i imagine that is its berekely homes who have brought the parking company in, it must be them......i will see if teh know. hold on!!!
can the just suddenly designate a road as private without telling those who have to use the road to get into their homes??
its just an estate and their home is a housing association house so they (everyone) assumed it was owned by the council.0 -
Your son, nor anyone else in the road, won't be paying these tickets, I'll tell you that now. I'm in a bit of a rush but there are others on here who can fill you in.
Legally you owe them nothing, is the upshot.Je Suis Cecil.0 -
yes, the council is paid for the permit.its a permit for the whole estate, and no one told them that certain roads were out of bounds.....
will tell them to get onto the council first thing monday and get back on hre. thanks to you all. very interesting thread this.xxx0 -
some further information.....
all the housing assoic tenants there had a letter from town and country housing assoc, telling them that berekley homes had instructed a parking fine company. the original company didnt work out, so this one took over. this was last year. and they started issuing tickets like mad but people started kicking off because they were sticking tickets on cars, 2 or 3 on the same cars within half an hour of each other. and tehy didnt come back for a while.
then one day they arrived with a tow truck and took away the cars that hadnt paid the fines.....0
