Early termibnation of motobility car. Advice please.....x

Hi, I was diagnosed with MS 13 years ago. I have had 2 previous cars with the motobility scheme which went withougt incident. The car I currently have is only 18 months into the contract and has already been involved in 3 accidents (none of which were my fault) this has caused a great amount of stress tom me as I was already an anxious driver. My Mum has been the main driver since then but unfortunately she is now not in a position to care for me or drive the car. We have both moved hundreds of miles away to be near other family members. The problem is that I now live just outside London where the traffic is far busier than I was used to. I have now lost all my confidence and the car now just sits in my drive redundant. I called today to try and explain my predicament but was told there were no valid reasons to terminate early. Is this correct does anyone know? I seem to be reading conflicting stories re this. They normally just take the car back when there is a change of circumstances and I would have though that this was a change of cercs.
RSA may have refused to insure you after the three accidnets anyway, it dont matter wether they are fault or none fault three accidents in 18 months is a lot and Ive heard of people losing thier cars for less.0 -
I have terminated a motability agreement early, as due to my OH having to retire on medical grounds we did not need 2 cars. They were quite happy to do this.0

Does not sound like a valid reason to be able to terminate. It's not change of your condition, its just you are afraid to drive I am sorry to hear.
I suppose pre-coalition government you might have been able to squeeze some pity from Motability, but now they are strictly run on business rules. A 3 year contract is just that, if you don't fulfil their get out clause you have to stick with the car, whether you want it or not.
Now RSA are no longer covering you (you need to check). What are you doing to protect yourself in the instance of damage on the drive.0 -

This is rubbish.
You can call Motability for any reason and cancel your contract.
If they don't think you have a valid change to circumstances they will ask you to pay a £250 termination fee.Unite Disability Champion & Equality Rep0 -
At no time in the post is there any mention of there being no insurance in force,do you honestly think that motability would have a car of theirs out on lease whilst having no effective cover in place?You pass comments without any knowledge whatsoever as to whether or not they will terminate the contract early,you quite blatantly state if you dont fulfill their get out clause that the poster will be stuck with the vehicle.I would err on the side of caution regards this matter and would edge my bets on motability going through with termination of contract.Being afraid to drive as opposed to being unafraid of driving is in real terms a change of circumstances in that her mental well being is now in doubt regards driving..thus i would call this a change of circumstances..for them to dismiss her request for early termination could in actual fact leave Motability culpable should she have another accident given that they were made aware of her admitting she was a liability whilst out on the roads.
And you need to read the one above. I was passing comment on Sunnyones suggestion that there's no insurance after three accidents! (Sorry Sunnyone if I have mis-read your comment)
Pauliboo, you are talking out of your hat. I have read my contract tonight and I cannot just cancel it without any reason. I suggest, you read the t&c's for Motability before passing comment yourself. You cannot just cancel because you don't want the car without penalty. It can cost you nearly a £1000 to get out of the agreement. You lose everything! Try reading the thread and the rules before telling someone it will cost them £250 to get out.

Reasons for ending your agreement

If you do cancel, there may be an administration fee to cover our costs. Any Advance Payment you have paid may be refunded to you on a pro-rata basis, less any administration fee, where applicable. Please contact us as soon as possible to discuss your needs.
If however, we cancel your agreement because you have failed to comply with the terms and conditions of your agreement, no refunds will be made to you, and you will be charged an administration fee.0 -
Yes that is true, but the OP has a genuine case. If she is too scared to drive the vehicle then it isn't fit for purpose.

Her Mobility needs have changed - she can't drive the car. There was a story in the Motability magazine about this a few months ago, and actually Motability waived the admin fee as they could see how much distress the car was causing.
Circumstances change all the time, especially for people with disabilities.
Motability have agreed that I can end my contract early, although I do need to pay the admin fee (which I'm happy to do), as my car is under performing. My Mobility hasn't changed but the car isn't fit for purpose.Unite Disability Champion & Equality Rep0 -
I had a mobility car a few years ago, and I asked to terminate the contract early as well.
The reason I gave was that I simply couldn't afford to keep the car, and also because the car was not in permanent use, and had very little mileage on the clock!!
They allowed me to return the car no problems and returned my £195 deposit back, mind you it took months to return this as they didnt rush!!
