    POPLA decisions are not binding on the motorist. If you lose you can still ignore. They are binding on the PPC.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?
  • POPLA have submitted their evidence and argued every point. However one thing that stands out is they say they have a contract with the landowner and can provide it if required but have not offered it in their evidence pack - is this a failure on their part?

    They argue the toss on all other counts i.e. signage is clear, I made a contract by being in the car park and in that contract I signed up to the £100 charge etc.

    Decision will be made on 7th May. I'm not confident it has to be said but who knows!

    When you say "POPLA", do you mean the parking company?

    If the parking company have not submitted the contract then that could go against them. In the last few weeks POPLA decisions have gone against PPCs because they have not submitted these contract.

    Be confident. Look at the recent POPLA decisions (top thread) where it's clear a PPC needs to show the contract!

    That would be interesting to see, but I doubt they will!

  • Apologies I meant PPS have submitted their evidence to POPLA.

    Wording re the contract "PPS have a lawful authority and a contract to operate on this Private Land. I am happy to produce this contract to POPLA and or the BPA to confirm this.

    Re the contract they state the contract is formed when driver enters the site and chooses to park in accordance with the signage. So language not saying signed up per se but effectively along those lines. Other areas addressed and argued alright. I'm kinda banking on the contract issue.

    They should submit the contract to you as well, otherwise how can you counter what it says ? This should be raised to popla as an appeal point, you are not allowed to submit something in defence without it being fully transparent to them, so why should they be able too? Do they have something to hide ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Thanks for that point. However, I thought POPLA was a one off opportunity and that evidence could not be submitted beyond the appeal hearing date? Granted that is 7 days away - could POPLA request it in that time or do thy just go on what they have got?
