PPS Parking Notice - I've already appealed

UPDATE Pg 3 - POPLA EVIDENCE SUBMITTED

SORRY - I have read the POPLA website and other threads but cannot see one reflecting my situation!

Received a PPS parking notice. Received it as my ticket blew over in the car and unfortunately landed face down. My immediate reaction was to appeal and so I emailed them telling them the situation and sending a photograph of the ticket I purchased.

THEN I read this forum!!!

I have received a follow up letter obvioulsy declining the appeal.

As I have already made contact and asked for an appeal does this mean I now have to pay it or should I just ignore it from this point onwards?

Any advice welcome as they say I now have to pay £100!!

    As you've appealed and they've turned it down, have they given you a popla code? When did you originally appeal ? They have 35 days from that date to supply a popla code or its the end of the matter.

    You have a choice now though, either ignore them completely, go to popla or wait 35 days and its the end of the matter if no popla code. Certainly don't pay them and don't communicate further.

    They can say you have to pay £1000000

    Just ignore them
    For everthing else there's mastercard.
    For clampers there's Barclaycard.
  • Yes they have provided me with a form for POPLA appeal.

    I sent them a appeal email on 1st Feb which yet say they received on 4th. Their letter is dated 12th but I got it yesterday however I did move address 3 weeks ago but last picked up mail 2 weeks ago and didn't have it then.

    There is no specific mention of a POPLA code but there is a verification code on the POPLA form they have provided.

    Do I still ignore or am I better off going through POPLA?

    It's up to you, you have 3 choices

    1) ignore completely
    2) go to popla with help to word your appeal
    3) pay the invoice

    Obviously it's your choice, I don't recommend 3 at all, it depends how much more time you want to give to this, ignore is the easiest. You've come this far if it was me I'd go to popla

    Agree with Stroma, no point asking for advice if you end up paying, it's a scam invoice. Appeal to POPLA cost the PPC £27, outcome is only binding on the PPC and not the driver

    And a 'prove you have a contract that allows you to pursue drivers for parking charges' defence to POPLA usually does the trick.

  • I certainly don't intend on paying unless there is a likelihood I am going to be taken to court and lose!!

    I've tried to do some reading on POPLA but I'm getting myself confused. What if they don't see in may favour? I had the ticket but was not displayed as it blew over so I contravened the notices in the car park technically. Do I then have to pay?

    Sorry I am sure it should be simple but legal speak just confuses me.

    If you lose at Popla you still don't have to pay, unless they take you to the small claims and win. But if it goes in your favour, then you don't pay and the parking company must drop the issue.

    This is an illegal penalty, and its highly unlikely to go to court as there are many many ways to get the claim thrown out.
