CCJ after commencement of IVA

Hi All,

I wonder if anyone can help with my current problem please.
I've been in an IVA for two years but recently I've disputed some Landlord/Tenant issues and lost through the Court so I guess a CCJ will be registered for about £2,000. How am I supposed to pay a CCJ when Im in an IVA as I don't have any spare money? Does my IP have to reduce my payments into the IVA so that I can make payments for the CCJ or will there be a charging order put on my property that already has £25,000 of negative equity?

    Did you seek any advise from your IP prior to the court action?

    I am so sorry to reply under this but I am new to this and freaking out. Its about credit files.

    My mam and dad live together married the only financial link between them is a joint bank account. My dad been refused for credit recently so he sent off for his credit file, my mam worried sick incase it lists her debts and he finds out about them, and I mean she is making herself physically ill! On my dads credit report will it list her debts or just that there is a financial link under associates and can you confirm he won’t find out about her debts?

    I have no sympathy for any partner who hides debts from the other partner as it causes so much distress time and again on here. Your 'mam' should come clean

  • Sorry for the delay in posting. I notified my IVA company but the problem is when you call them you only speak to someone taking messages and not someone who can give you answers. That means that although i've notified them, I am now waiting to hear from them with what I do next. I posted on here because I was worried and wanted a quick answer. Incidentally, weeks later I still haven't heard from my IVA company and no-one here could help so I still don't have a clue what lies ahead.
  • OK if you have tried your IVA company- you may need to send something over in writing and recorded delivery if they are that bad at responding.
    However- if there is a CCJ you will be asked to send a statement of your income and outgoings so the judge can order what needs to be repaid. You must stress on there that you are already in an IVA and your payments are fixed- then it's up to the judge to decide what you can afford to pay back.

    Have you tried speaking to Citizens Advice?
    now debt free and determined to maintain good spending habits and build savings
  • Hi, I have had this situation recently. I spoke to my IVA provider who suggested failing the existing IVA and then reproposing a new IVA with the CCJ and other new debts in it. Unfortunately this advice led to me accepting the ccj (which I didn't want to) and then finding that the IVA provider had forgotten that in my original IVA my main creditor is HMRC and they would still be the main creditor and they don't accept a 2nd IVA so I have had to accept the CCJ and stay in the IVA and try to settle both which is causing me issues.
