Reclaiming Credit Card Charges On A Defaulted Credit Card

Can i do this?

I was with American Express, and they ripped me off chronic. They ended up sending me a letter, saying i had 10 days to make a minimum payment; but the letter arrived 7 days late. They wouldn't entertain the fact it was late, and after a long battle involving the CAB, i eventually cleared the debt via a debt collecter.

Am i able to reclaim any charges they made to me during the time i had the card, even though i ended up defaulting on it?

    You don't say how they ripped you off.
    To get accurate advice you need to supply more information.

    A debt does not go to a debt collector straightaway!
  • Its not really a question of can i remove the defualt or fight it. It was a couple of years ago now.

    All i want to know is can i reclaim the charges (for late payments, going overdrawn etc.) even though i defaulted on the card.

    By defaulted do you mean the debt has been written off?

    if so, you are asking if you can reclaim charges that you did not pay in the first place.
  • No, i paid the debt off to American Express via debt collectors

    Yes you can, doesn't matter if the account has been defaulted, you can still claim back over the previous 6 years.

  • Yes you can still reclaim the charges. It does not matter if the account was closed/passed to collectors etc. The charges are still unlawful. Just follow the advice on these boards.
