I am a community Care assistant on Monday a client fell on me about 17 stone and I damaged my back I went to doctor yesterday and was advised not to work and see how it goes I called my employer and told them I wont be in but last night I got a text saying will I be in this morning I wrote back saying sorry I will be in my back is still sore ( I missed out not) now i got a call to say I'm getting a disciplinary as I didnt show for work is thia fair

I went to doctor yesterday and was advised not to work and see how it goes.

I called my employer [when?] and told them I wont be in but last night I got a text saying Will I be in this morning? I wrote back saying 'Sorry I will be in my back is still sore' ( I missed out not) now I got a call to say I'm getting a disciplinary as I didn't show for work is this fair?

I have amended this with punctuation to scan a bit better.

When you say damaged your back, what has the doctor said you have done? How long did he advise you to be off for, and did he give you a sick note?

Did you comply with their sick procedure to report this and your sick day yesterday?

And yes, missing out 'not' does infer that you will be back in work. So from their point of view, you have said you will be in and then didn't attend.

What are their procedures to stop a client falling on you? Have you had training in handling clients?

Thank you for your reply, the doctor said its possible muscle damage and to have a week off I have to self certify this, then he will give me a sick certificate

We were told in manual handling if a client falls we are not to catch them but I had no choice I didn't catch him he just fell on top of me
I dis report this and filled in an incident report

I'll just have to accept the disciplinary

Who did you speak to when you called to tell them you wouldn't be in?

Do you have written confirmation of who you should speak to when you are sick from work?

I spoke to an office supervisor there is no written confirmation on who to speak too

To be honest, they shouldn't have texted you, they should have either called and spoken to you or waited for you to call in sick today.

I wrote back saying 'Sorry I will be in my back is still sore' ( I missed out not).

The problem is that your text informed them you will be in. And so they were expecting you and you did not turn up. They would presumably have arranged cover for you otherwise, so it would have caused them a problem.

At the disciplinary you'll have to apologise for the error and say you'll be more careful another time, and see how they take it.

Have you got a zero hours contract by any chance?

Did this go into the accident book?

If you are unavailable for work for 7 days [not including the day it happened] then it is reportable under RIDDOR.

I think it is their way of telling you to milk it and claim compensation for work related injury.
