Ex display is faulty

I've just received a lenco tower docking station that I purchased from eBay it was described as new item that was ex-display. Once opened and put together I noticed that the LCD display panel was not working I turn the stereo off the display panel was still flashing.

I got this item at a very reasonable price, so I would like it replaced if possible, we're do I stand legal for a replacement or would it be a case of a refund? Please help.

    The retailer can either replace, repair, or refund - the choice is theirs.

    If the OP wants a full refund then this is what the retailer must legally give, and they do not have to accept a repair or replacement.

    The repair, replace or refund option only applies if a consumer is deemed to have accepted the goods and not if they were faulty on delivery or a fault appears within a short time afterwards.

    Point being the OP can not demand a replacement, which is what he wants, the refund is a given in this situation so that's not the point of the thread.

    I was just correcting what is a common misconception regarding a sellers rights when faulty goods have been sold.
